proposed by the applicant under this Section must be found acceptable by County Counsel prior to the public hearing on the permit. The type of financial guarantee may be, but is not limited to, the following: (1) A faithful performance bond. (2) A property escrow or escrow account. (3) A trust fund. c. Prior to commencement of operations, a revegetation plan shall be approved by the Department of Fish and Game. A copy of this approved plan shall be submitted to the Planning Division. d. Final elevations within 25 feet of any property boundary must be equal to or greater than the abutting property unless the elevation prior to excavation is less than that of the abutting property, in which case the differential shall not be increased. e. Final slopes cannot exceed 1-112 feet horizontal to 'I foot vertical. f. All water utilized in the plant operation must be disposed of behind a closed dike. g. Stockpiled soil or material cannot be stored within 25 feet of a property boundary. h. Private roads involved in the excavation must be maintained to control the creation of dust. The first 100 feet of any private road on the property which intersects with a publicly maintained road must be surfaced in a manner approved by the agency responsible for the maintenance of the public road. Traffio-control and warning signs are required at the intersection. The placement, size, and wording of these signs must be approved by the agency responsible for the maintenance of the public road. E. Excavation operations shall not be carried on during the hours from 9:00 p.m. through 5:00 a.m., except during periods of declared national, state, or local emergency. The hours shall be based on either Pacific Standard Time or Pacific Daylight Saving Time,whichever is legally in effect. j. Any night lighting established on the property must be arranged and controlled so it will not illuminate or cause any glare onto public rights-of--way or adjacent properties. k. All emissions are subject to the rules and regulations of the San Joaquin Air Pollution Control District. 1. Operations shall be in accordance with instructions from the Agricultural Commissioner to control the spread of noxious weeds. m. The excavation must not cause health or sanitary hazards and shall not create conditions which will cause the breeding or increase of mosquitoes, rodents,or other pests. n. The operating practices utilized must minimize noise,vibration,dust, and unsightliness. o. The rehabilitation of each phase shall be completed, in conformance with the rehabilitation plan, within two years of completion of the extraction portion of that phase. p. The applicant must pay a fee of$150 to the County to cover the cost of any annual inspection of the operation to assure compliance with the provisions of the permit.
