PLANNING COMMISSION MINUTES <br /> APRIL 1, 1993 <br /> 1 . SITE APPROVAL APPLICATION NO. SA-92-41 OF JOE HARDESTY (C/O B. <br /> DEMAR HOOPER) : An appeal of Conditions of Approval for an approved <br /> Site Approval application to excavate 297 , 650 cubic yards of soil <br /> to create two fish ponds. The project site is located at the north <br /> end of Kennefick Road, 2650 feet north of Liberty Road, north of <br /> Lodi (Supervisorial District 4) . Continued from March 18 , 1993 . <br /> Comms. Morri and Jungeblut indicated that they had viewed the site. <br /> Several Commissioners indicated that the applicant had talked with <br /> them. <br /> Associate Planner Chandler Martin introduced a staff report into <br /> the record. Page 2 , first paragraph, first sentence was corrected <br /> to read: "On September 7 , 1991, Enforcement File No. EN-92-157 was <br /> opened due to the operation of a grading excavation on this site <br /> without a permit. " <br /> Chuck Kelley, representing the Department of Public Works, said <br /> that if the appeal is upheld by the Commission, Public Works would <br /> like to set new conditions concerning the haul route. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: Attorney Demar Hooper (Sacramento) was present and <br /> asked that the appeal be granted. He made the following points: <br /> • When the waterway floods, it leaves debris and sand. The sand <br /> is not suitable for farming. He proposes to remove the debris <br /> and soil. <br /> • There are wetlands scattered throughout the site. <br /> • The lower portion of the property is not good for farming <br /> purposes but is appropriate for the creation of fish ponds. <br /> • The removal of the soil and the creation of fish ponds will <br /> benefit the Swainson' s hawk, the giant garter snake and the <br /> tiger salamander. <br /> OPPONENTS: Attorney William Porter (Sacramento) , representing Ron <br /> Bohlender, property owner to the north, asked that the appeal be <br /> denied. He made the following points: <br /> • The flooding problem would be solved by repair of the existing <br /> levees. <br /> • The Swainson' s hawk would be more benefitted by leaving the <br /> grassland than by the creation of the fish ponds . <br /> APR 1, 1993 <br /> PC MINUTES -6- <br />
