• The Hardesty property is under zoning enforcement due to the removal of soil without a permit. Every couple of days there were 4 or 5 loads of soil coming off of that land. This activity went on for about one year. • The previous owner of the subject property put in a year- around irrigation system. • The removal of topsoil from this property will ruin the property; and a considerable amount of this soil has already been removed. • The excavation area will leave an unsightly problem if the fish pond is not developed. A 15 foot deep hole is not needed for a fish pond. • A dirt quarry will create a dust problem. • The haul trucks will create a hazard for school children in the area. • The fish pond will increase the need for mosquito abatement. • This use of the property will lower the property values in the area. • Approval of this appeal will set a precedent for other requests to remove soil from property in the area. Jerry Mensch, representing the State Department Fish and request(Rancho Cordova) , said he is not in oppositionto he wanted to make the following points : • The site is needed for a foraging area for the Swainson ' s hawk. • Diversion of water from the surface water supply for a period of time longer than 30 days will require a permit from the Department of Water Resources. • The proposed fish ponds have a high potential to cause a change in the channel alignment in that area with associated impacts. • The Department of Fish and Game does not believe that such a project would have any benefit to the giant garter snake or the tiger salamander and it could be deleterious . Farm ponds have never been identified as giant garter snake habitat. • The depth and shape of the ponds would make it difficult to harvest the fish.
