Analysis <br /> Background <br /> On July 6, 1978 the Planning Commission approved Parcel Map application PM-78-196 to subdivide a <br /> 132 acre parcel into seven parcels. Parcels "A" and "B" to contain 2.0 acres each. Parcel "C" to contain <br /> 41.9 acres, Parcel "D" to contain 1.0 acre, Parcel "E" to contain 9.9 acres, Parcel "F to contain 13.0 acres <br /> and Parcel "G" to contain 63.4 acres. As a condition of approval a note was placed on the map for <br /> Parcels "C","E","F" and "G' restricting the parcel from the ability to build a single-family residence. <br /> Prior to adoption of the Development Title in 1992, restrictions were commonly placed on Parcel Maps to <br /> create homesite parcels and designated remainders, that restricted a residence from being built on the <br /> remainder parcel. The purpose of this was to prevent additional residences being built in the AG zones <br /> on smaller parcels. Prior to the existing regulations contained in the Development Title being put in place, <br /> the regulations for creating homesite parcels in the AG-40 zone (General Agriculture, 40-acre minimum) <br /> were more permissive and as a result there were numerous abuses of the homesite provisions, resulting <br /> in fragmentation of agricultural land. When the current Development Title was adopted in 1992, the <br /> regulations for creating new homesite parcels were changed and made more rigorous. Now the <br /> requirements for creating a homesite parcel are more restrictive, however the remainder may be built <br /> upon. This Revisions of Approved Actions application is to remove a note only and will enable the owner <br /> to apply for a building permit to build a single-family residence. <br /> Certificate of Correction <br /> If the Revisions of Approved Actions Application for PM-78-196 is approved by the Planning Commission, <br /> the applicant will need to file a Certificate of Correction with the County Surveyor to remove the note <br /> preventing the owner from the ability to build a single-family residence. <br /> San Joaquin County PA-1200169\Brenkwitz <br /> Community Development Page 3 <br />
