Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Revisions of Approved Actions Application No. PA-1200169 with the findings and <br /> revised conditions of approval contained in the staff report. <br /> Findings <br /> 1. There are changes in circumstances which make any or all of the conditions of such map no longer <br /> appropriate or necessary. <br /> • This finding can be made because under current Development Title regulations for the AG-40 <br /> zone (General Agriculture, 40-acre minimum), a single-family residence is a permitted use. <br /> (Development Title Table 9-605.2). Except for setback requirements,there are no current <br /> Development Title requirements regarding the restriction of building a single-family residence in <br /> the AG-40 zone. <br /> 2. The amendments do not impose any additional burden on the present fee owner of the property. <br /> • This finding can be made because the present fee owner is the applicant and this application is <br /> a benefit to the present fee owner. Moreover, a Revisions of Approved Actions application to <br /> permit a parcel to be buildable does not impose any additional burden on the present fee owner <br /> of the property. <br /> 3. The amendments do not alter any right, title, or interest in the real property reflected in the recorded <br /> map. <br /> • This finding can be made because the Revisions is only to remove a note restricting the ability <br /> to build a single-family residence.
