Trinkle and Boys Ag Flying Service, Inc. , (hereafter Discharger) operates a <br /> pesticide application business (facility) located at 31244 S. Highway 33, <br /> 1racy, in the 00_11(;ast: quarter of the southeast quarter of Section 17, <br /> !__<S, R6E. MDB&.M. (:Ser' ocip, Attachment I. ) <br /> The Discharger currently collects pesticide rinse water and stores it in an <br /> obove-ground tan€. -or ;'ease or off-site disposal . However, for approx- <br /> i gale ly 40 year's prior to 1986 , the Discharger caused rinse water to be <br /> �- discharged to ground at this facility. This disposal history indicates <br /> that pesticide residues in site soil have been, or probably will be, <br /> discharged into waters of the state. <br /> 3_ Area ground water is less than 10 feet below the surface. The facility is <br /> within the New _lerusalem Drainage District, and the drained areas exist <br /> less than one-a+jarter mile east and ore-half mile west of the facility. The <br /> tile drainage Is discharged to the San Joaquin River. Area surface <br /> drainage also flaws- towards the San Joaquin River. <br /> 4.. Beneficial uses of the San Joaquin River are agricultural and industrial <br /> supply, recreation, and fish and wildlife habitat, <br /> 5. Beneficial uses of the area ground water are irrigation, stock watering, <br /> and 'industrial end dem�,stir. °; ,poly. Ground water serves the domestic needs <br /> of residerices locatt'-i itrer+ediately adjacent to this facility. <br /> .. 6, The Board ' s Water Qj,-ality Control Plan was amended by Resolution 79-149, <br /> adopted 22 June 1.979, to read "Facilities developed for handling pesticide <br /> rinse waters shall not allow percolation to underlying soils or ground <br /> waters. " <br /> Sampling conducted by Board staff on 17 June 1986 revealed that 12 pesti- <br /> cides were present: in the shallow ("perched") ground water encountered at <br /> 18 inches depth adjacent to the application equipment wash area at the <br /> site. Additional pesticides were present in. soil samples from the facil- <br /> ity. Because pesticide residues have entered the perched water, and have <br /> entered or are likely to enter the lower ground water or surface water, the <br /> Discharger has created, or threatens to create, a condition of nuisance and <br /> pollution. <br /> 8. On 17 March 1987, -the Discharger was requested, pursuant to Section 13267 <br /> of the California. dater Code, to submit a work plan and time schedule for <br /> an investigation to determine the horizontal and vertical extent of soil <br /> contamination and ground water degradation caused by on-site waste dis- <br /> charge. <br />
