San Joaquin County Community Environmental Setting,Impacts,and Mitigation Measures <br /> Development Department Agricultural Resources,Land Use,and Planning <br /> San Joaquin County Development Title (Title 9) <br /> The San Joaquin County Development Title establishes permitted uses of each of <br /> the categories of land uses designated by the County General Plan,including _ <br /> agriculture. The General Agriculture(AG)Zone is established to preserve <br /> agricultural lands for the continuation of commercial agricultural enterprises. <br /> This zone is intended to implement the AG County General Plan land use <br /> designation. Section 9-845.2 allows quarry excavation in AG zones provided <br /> that: <br /> 1. areas for excavation are designated by the General Plan as"Resource <br /> Conservation"and the State Mining and Geology Board has identified the <br /> areas as construction aggregate deposits of regional significance;or <br /> 2. the portion of the property to be excavated contains substantial deposits of — <br /> mineral resources or a portion of a deposit of substantial mineral resources; <br /> or <br /> 3. the soil on the parcel is not classified as either Prime Farmland,Farmland of <br /> Statewide Significance,or Unique Farmland. <br /> The Development Title further states that quarry operations are permitted on <br /> lands zoned AG,provided that a Quarry Excavation Permit is obtained(Table 9- <br /> 605.2)(RDT 2004). <br /> San Joaquin County Right-to-Farm Ordinance <br /> The San Joaquin County Right-to-Farm Ordinance(Section 6-9000 et. seq. of <br /> Title 6)is intended to preserve,protect, and encourage the development and <br /> improvement of the County's agricultural land for the production of food,fiber, <br /> and other agricultural products. The purpose and intent of the ordinance is to <br /> reduce the loss of agricultural resources by limiting circumstances under which <br /> agricultural operations or activities may be deemed or constitute a nuisance. <br /> A right-to-farm ordinance creates a legal presumption that ongoing, standard <br /> farming practices are not considered a nuisance to adjoining residences. <br /> Residents are notified that farmers have the right to farm using normally accepted <br /> farming practices,which means occasional dust,odors, and noise. If a dispute <br /> occurs, a grievance committee will work to resolve the dispute. <br /> San Joaquin County Multi-Species Habitat and Open Space <br /> Conservation Plan <br /> The San Joaquin County Multi-Species Habitat and Open Space Conservation <br /> Plan(SJMSCP)has been prepared by the County and its cities to provide a <br /> regional approach to mitigating development impacts on the 100 listed and _ <br /> nonlisted plant, fish,and wildlife species covered by the SJMSCP, compensating <br /> for the conversion of open space to non—open space uses. In addition,the <br /> SJMSCP provides some compensation to offset the impacts of open space land _ <br /> conversions on other beneficial open space uses, such as recreation, agriculture, <br /> scenic values, educational purposes, flood control,and use by common plant, <br /> fish, and wildlife species that are not included in the list of SJMSCP-covered <br /> species.
