The reclamation:plan must be <br /> augmented with a description of the type of agriculture that will be developed <br /> following mining. _ <br /> The reclamation plan contains minimal information regarding the present <br /> agricultural use, referring simply to "tree crops." Also, there is no reference to the — <br /> status of the property regarding its status as prime agricultural land yet the soil <br /> description describes soils on the northern portion of the project that qualify as <br /> prime by the US Soil Conservation Service. The description of the end use must be — <br /> adequately specific to provide a basis for detailing reclamation of the project to fulfill <br /> the requirements of Article 9 Standards (§3707) for prime agricultural lands. <br /> The plan is non-specific regarding the fate of Stage III. The text and engineering <br /> drawings indicate that Stage III may or may not be left as an approximately 15-acre <br /> agricultural pond with 1.5:1 slopes. There is no discussion of possible uses of the <br /> pond for agriculture. The steep banks of 1.5:1 preclude the use of the pond for <br /> livestock. Slopes steeper than 2:1 are generally considered to steep for an animal <br /> or a person to extricate themselves from the water. The pond could be considered <br /> a hazard if left with banks of 1/5:1 (Page 5, Paragraph 2, Item 3, Reclamation Plan). <br /> The plan also states that if Stage III is backfilled the source of the backfill material <br /> will be from offsite. If the pit is backfilled the source of the backfill material needs to <br /> be discussed and evidence needs to be provided that the backfill material will be <br /> suitable for the agricultural end use. — <br />
