(Draft EIR,pp. 4.7-17 to 4.7-19, 9-6.) <br /> Responses 5-6: The SMARA regulations require that"surface runoff and drainage from <br /> surface mining activities"be"controlled by berms, silt fences, sediment ponds, <br /> revegetation,hay bales, or other erosion control measures." For this project, storm <br /> drainage will be self contained within the project site, and will be directed to the silt <br /> ponds or mining pits using berms, ditches, and pipes to minimize erosion and <br /> sedimentation. The drainage will be recycled or used to recharge the groundwater. <br /> (Reclamation Plan, pp. 4, 6, 18;Draft EIR,pp. 3-14 to 3-15, 4.8-33.) In addition, as <br /> noted in your comment, a SWPPP will be prepared for this site,which SWPPP will also <br /> meet County and SMARA requirements for erosion control. (Draft EIR,pp. 4.8-16 to _ <br /> 4.8-17.) The SWPPP will include the use of straw bales as necessary. <br /> Response 7: Because the majority of the project site is designated"Prime Farmland"by _ <br /> the DOC, the reclamation plan will require that when distinct soil horizons are present, <br /> the topsoil will be salvaged and segregated by horizon. (14 Cal. Code Regs. § 3707(b).) <br /> Response 8: Topsoil will be stockpiled along(but not within)the perimeter setbacks for <br /> later use in reclamation. (Reclamation Plan,pp. 6, 8-9; Draft EIR,p. 3-13.) The <br /> Reclamation Plan figures will indicate stockpiling locations along the perimeter setbacks. <br /> Response 9: The project site currently supports primarily apricot orchards. (Reclamation <br /> Plan, pp. 1-2; Draft EIR, pp. 4.3-1 to 4.3-2.) The site will be reclaimed to agricultural _ <br /> uses with productive capability equivalent to or exceeding pre-mining conditions or <br /> similar crop production in the area. Reclamation will be deemed complete when such <br /> productive capability is met for two consecutive years. (Reclamation Plan,pp. 15, 19; _ <br /> Draft EIR, p. 3-26.) The EIR contains mitigation(Measure 4.3.4,pp. 4.3-12 to 4.3-13) <br /> requiring the Reclamation Plan to include elements to maximize fixture productivity of <br /> the soil resource for agricultural cultivation. The Reclamation Plan will incorporate these _ <br /> elements. <br /> Response 10: The Reclamation Plan will be revised to include monitoring methods and <br /> success criteria for revegetation of slopes to be used as grazing land. The success criteria <br /> will be 75%cover by grasses, forbs, or legumes. As noted in the Reclamation Plan, <br /> Section 1ILH,monitoring would occur annually after planting for a period of two years. <br /> Monitoring sample sizes will be set to achieve an 80%confidence level in the results. <br /> Response 11: Under the Reclamation Plan, noxious weeds will be managed during the <br /> revegetation effort to ensure revegetation success, to prevent weeds from spreading, and <br /> to eliminate any fire hazard. Control measures will include mowing, grazing, and/or <br /> herbicide application, as necessary. — <br />
