The San Joaquin County Planning Commission will be considering the proposed <br /> reclamation plan and financial assurances for the Cemex Vernalis Quarry at its regular <br /> meeting on July 3, 2008, at 6:30 P.M. in the Public Health Auditorium at 1601 E. <br /> .. Hazelton Avenue, Stockton, California. This letter serves as 30-day notice of the <br /> proposed action pursuant to Public Resources Code Section 2774(d)(2). <br /> r, San Joaquin County in this letter also addresses the comments provided in your letter of <br /> July 14, 2006, a copy of which is attached hereto. Draft responses to your comments are <br /> included herein, and the County will forward its final responses to your comments within <br /> .. 30 days following approval of the Reclamation Plan, as directed by Public Resources <br /> Code § 2774(d)(2). The final responses will include any amendments that the Planning <br /> Commission may direct at their hearing. <br /> .. Response 1: The proposed end date for mining is 60 years from commencement, i.e., July <br /> 3, 2069. Mining is proposed to commence within one year of final project approval by <br /> the County, to continue in eight phases. (Reclamation Plan, p. 8; Final BIR,p. 4-2.) <br /> Response 2: The maximum anticipated depth of mining is up to 120 feet below the <br /> ground surface, depending on the groundwater level. (Draft EIR, Section 3.6.2.)The <br /> project site ranges from 159 to 211 feet above mean sea level(Draft EIR, Section 3.5), <br /> thus, if the maximum depth of mining occurred at the lowest point onsite, the anticipated <br /> maximum depth would be 39 feet above mean sea level. <br /> Responses 3-4: The SMARA regulations do not require site-specific geologic and <br /> engineering analysis regarding minimum slope stability unless final slopes would exceed <br /> 2:1. (14 Cal. Code Regs. §§ 3502(b)(3), 3704(d).) Here, all final slopes would be <br /> backfilled to 2:1 (Reclamation Plan,p. 17; Draft EIR, p. 3-25), and thus,the additional <br /> .. analysis requested in Comments 3 and 4 is not required in this instance. However, in <br /> addition to the 2002 Geomatrix report,the Draft EIR also relied on a 2005 geotechnical <br /> 4 <br /> 6 <br />
