minimum, the upper three feet reconstruction surface soils shall have an organic content of one <br /> percent. The plan shall demonstrate that potential migration of amendments to surface water or <br /> groundwater shall not result in reduction of water quality. In addition, the plan shall provide for <br /> procedures and specifications for a soil fertility and crop productivity monitoring program for test plots <br /> within the Phase I mining/reclamation area. Productivity goals shall be established on the basis of <br /> crop productivity of adjacent lands currently under agricultural production. , <br /> A soil sample analysis from an independent laboratory shall be submitted for two-foot and four-foot <br /> depths (five random sample locations per 100 acres) of reclaimed soil. The analysis shall <br /> demonstrate that a minimum of 85 percent of the soil samples meet the specifications of the Soil <br /> Reconstruction Plan. <br /> x. CULTURAL RESOURCES: The excavator shall cease all construction and excavation work <br /> immediately upon the discovery of cultural resource material. Such work shall cease until the <br /> excavator has complied with the requirements of Appendix K of the CEQA Guidelines. i <br /> y. INDEMNIFICATION: The owner shall defend, indemnify, and hold harmless the local agency or its <br /> agent and employees from any claim, action or proceeding against the local agency or its agents, <br /> officers, or employees to attach, set aside, void, or annul an approval of the local agency, advisory <br /> agency, appeal board, or legislative body concerning this Quart'Excavation permit. <br /> z. SEDIMENTATION POND DIKE DESIGN:A registered engineer shall design the proposed � <br /> sedimentation pond dike. The design of the dike shall be reviewed and approved by an independent <br /> engineering or geo-technical firm selected by the Community Development Department. Said review <br /> shall be at the expense of the applicant. No more than fifty(50)acre feet of water shall be stored <br /> against said dike. <br /> 2. DEPARTMENT OF PUBLIC WORKS <br /> ' I <br /> a. The excavation plan shall be prepared by a Registered Civil Engineer and include the following: <br /> .µ <br /> (1) Detail of access road (first 100 feet from either Koster Road or Blewett Road shall be paved. <br /> (2) Haul route. <br /> (3) Stockpile area for topsoil. <br /> (4) Any stockpile or excavation shall be 25 feet clear of the Koster Road right-of-way. <br /> b. Loads shall be restricted to legal loads only. (Streets and Highway Title Section 10-2350) <br /> c. A video tape of road conditions on Koster Road, Blewett Road, and Bird Road,along the haul route, <br /> is required pdorto the start of excavation. The condition of these roads shall be reviewed with the <br /> Department of Public Works prior to the start of excavation and every five years thereafter. <br /> (Development Title Section 9-1415.2) <br /> d.
