r <br /> 'pursuant to Suce and Mining Reclamation Act (SMARR) Section 2773(b) and ' <br /> approved by all agencies with permit authority prior to initiating the use. <br /> ii <br /> c. STOCKPILING: No stockpiled soil or material shall be placed closer than <br /> twenty-five (25) feet to a property boundary. (Development Title Section 9- <br /> 1415.3[b]) <br /> (1) The topsoil shall be set aside, and upon completion of an excavation, the topsoil <br /> shall be replaced and the site leveled in conformance with the excavation <br /> permit. (Development Title Section 9-1415.3[g]) <br /> :1 <br /> (2) The reclamation plan shall be modified to specifically require segregation (into <br /> stockpiles) of the A- and B-horizons of the existing soils shall be reserved to <br /> serve as the uppermost layer of soil in areas of the project site to be <br /> revegetated. The applicant shall maintain a master map of stockpiled soils, <br /> identifying the location and quantities of the segregated soils. <br /> (3) As an altemative to stockpiling topsoils, this requirement may be waived if a <br /> soils report indicates that replacement of the topsoil will not enhance the <br /> agriculturat suitability of the property(Development Title Section 9-1415.3[g]) <br /> d. PRIVATE ROADS: All private roads involved in an excavation shall be maintained <br /> so as to control the creation of dust. The first one hundred (100) feet of any private <br /> road on the property which intersects with a publicly maintained road shall be <br /> surfaced in a manner approved by the Director. Traffic-control and warning signs <br /> shall be installed, if required, at such intersection. The placement and size of these <br /> signs shall be approved by the Director of Public Works. (Development Title Section <br /> 9-1415.3[c]) <br /> e. EROSION CONTROL: Protective vegetative planting, silt screen dams, or other <br /> approved methods shall be required where necessary for the control of erosion. An <br /> erosion and sediment control plan approved by Development Services Division <br /> shall be part of the reclamation plan. (Development Title Section 9-1415.3[d]) <br /> f. PERFORMANCE STANDARDS: Standards contained in Chapter 9-1025 shall be <br /> met unless otherwise modified by conditions of the Quarry Excavation Permit. <br /> (Development Title Section 9-1415.3[e]) <br /> g. HOURS OF OPERATION: Plant operations shall normally be carried on during the <br /> hours from 540 a.m. and 940 P.m. (Development Title Sep-Ainn 9-4445--.43[%-1:30 <br /> a.m. and 5:30 p.m. The following conditions of approval shall apply to mitigate <br /> noise impacts: <br /> i? <br /> (1) Aggregate stockpile locations shall be maintained at their current positions as <br /> those stockpiles provide partial shielding-of processing area noise to the <br /> nearest residences to the east and south. <br /> 11 <br /> (2) Early morning/nighttime mining activities within 600 feet of any residence <br /> shall not occur unless that equipment is recessed at least 40 feet within the <br /> pit so as to be substantially shielded from that residence. <br />
