B.) Condition 1-u requires the applicant to store water, in the initial settling pond, <br /> below the invert of the Delta Mendota Canal. The applicant would like to store <br /> water, in this pond, at an elevation higher that the invert of the Delta Mendota <br />' Canal. This option was addressed in the E.I.R. 96-03, as Mitigation Measure <br /> 4.2-7a, however was not listed as an option-on the Conditions of Approval. At <br /> this time,the applicant would also like to revise the location of the initial settling <br /> pond from the northwest corner to the northeast comer of the property, and add a <br /> dike around the top of the pond. The pond was relocated due to a change mi <br /> location of the access road that leads to Blewett Road (noted as alternate #3 in <br /> r E.I.R. 96-03). The addition of the dike around the top of the pond will partially <br /> increase the holding capacity of the pond and act as a safety barrier between the <br /> pond and surrounding areas. The dike will be engineered and constructed to meet <br /> governing regulations for such a project. Any water stored behind the dike will <br /> be less than 50 acre-ft. and therefore will not require a Dam Safety Permit. The <br /> applicant understands that an en <br /> pp gineering analysis, with recommendations for <br /> mitigation to offset any potential impacts, must be submitted to the development. <br /> `department for approval.
