This land was sold as excess right-of-way associated with the construction of the <br /> Delta-Mendota Canal. As such it contains deed restricting the removal of mineral <br /> resources from the property. In March of 2000,I requested this restriction be <br /> removed. As evidenced by the attached letter of March 24,2000, The retention <br /> ! of mineral rights by the United States in this case would also limit the subsurface <br /> acitivities,the request to remove or modify the mineral reservation cannot be <br /> � accommodated." <br /> 2. Even if you could get past this limitation, the setback that would be required leaves <br /> little of the property eligible for excavation. The United States Department of the <br /> Interior in their 1993 correspondence relative to a Granite Construction proposal for a <br /> quarry on the east side of the canal requests a 100' setback from their right-of-way- <br /> Combined with the 25' setback from properly lines,the potential surface level <br /> footprint of the excavation would be as follows: <br /> Parcel i-less than 10,000 sq-ft <br /> Parcel 2-approximately 4.68 ac_ <br /> Parcel 3-approximately 6.16 ac. <br /> Further restrictions of I:i slope requirements from property lines(S.I Development <br /> 1 Title 9-1415.3 (k)(4))limit the depth of excavation to 0' (as in you can dig at al!)at <br /> the north end of the potential foot print of excavation 137' at the south end.
