Reserved Mineral Rights - Quitclaim Deed - Delta-Mendota Canal
(Unit #`s C-19B and C-25)
Dear Mr.Towers:
The United States Bureau of Reclamation Instructions, Chapter 8, Part 215, was
in place at the time this Quitclaim Deed was issued. Part 215.8.SD(12) of
these disposal instructions specifically requires the conveyance document to
contain a mineral reservation to the United States. As retention of mineral
rights is common practice in the issuance of patents and other Federal and
private lands transactions, it is unlikely that the subject mineral
reservation would preclude the owner from developing the property for
residential purposes. The retention of mineral rights by the United states in
this case would also limit subsurface activities by other parties which could
damage the Delta-Mendota Canal. Given the requirement to reserve mineral
interests to the United states and the potential damage to the Delta-Mendota
Canal from subsurface activities, the request to remove or modify the mineral
reservation cannot be accommodated.
If you have any questions, please contact me at (559) 487-5409 or for the
hearing impaired at (559) 487-5933.
Sincerely,
Robert Johnson
Realty specialist
South-Central California Area Office
