V F,d <br /> Finding A. Consistency: Discussion <br /> San Joaquin County General Plan Policy <br /> The Koster Road property is located within an area of active and approved gravel <br /> quarries.. Prior to setting forth the Objectives and Policies, the text of the General Plan <br /> includes the following discussion: <br /> "Pursuant to the California Surface and Mining and Reclamtion Act.of 1975 (SMARA), <br /> the mineral deposits in San Joaquin County have been identified and classified by the <br /> State Geologist in Special Report 160, issued August 1988. Also required by SMARA, <br /> the State Mines and Geology Board has designated the sand and gravel deposits that are <br /> of regional and statewide significance(see Figure VI-4)." (Volume 1, VI-16) <br /> The map associated with the Stockton-Lodi region Designation Report 9R is attached. <br /> As shown on the Designation Report MRZ-2 Section Map, most of the subject property is <br /> not included within any MRZ-2 Sector. MRZ-2 Sector C-8 does cover a portion of the <br /> property. Sector C-8 was specifically excluded from Significant Resource Sectors <br /> identified in General Plan Figure VI-4. Extractive Resources Policy I does not apply, nor <br /> do any of the implementation measures associated with Policy 1. <br /> The subject property is not suitable for mining because of small size, shape, deed <br /> restrictions imposed by the federal government which preclude excavation below a level <br /> of six feet. As such,the property is found to be not suitable for mining. <br /> FINDING B. Improvements <br /> Improvement of the property is regulated by the San Joaquin County Development Title. <br /> Generally all improvement of the property is subject to minimum standards as adopted in <br /> the Development Title. Consequently, all facilities necessary for the orderly and proper <br /> development of the property are required as a matter of adopted regulation. Existing and <br /> proposed improvements of the property will be connected via a paved driveway to a <br /> paved and public Koster Road, <br /> FINDING C. Site Suitability <br /> Substantial onsite technical investigation of the soil and water quality were conducted on the <br /> property. (Chesney Consulting-"Nitrate Loading Study Soil Suitability Study", September <br /> 2004.) (Submitted to SJ Environmental Health Dept. 9/13/2004, Service Request#SR0039594) <br /> The study considered residential use of the property and the parcels to the south and north, a total <br /> of 18.96 acres, and found that no special engineering for septic systems would be required, and <br /> due to relatively high background levels of nitrates,residential use would likely lower nitrate <br /> levels. Water quality was found to be within MCL criteria for domestic consumption, but <br /> moderately restrictive for irrigation.Two years later Chesney analyzed light industrial use of the <br /> property-concluding that the property could support 140 employees or 7.38 employees per acre <br /> without specially engineered sewage disposal systems. As such,the site is physically suited for <br /> the proposed project. <br /> 2 <br />
