t r <br /> FINDING A Issuance Not Detrimental <br /> Planning staff prepared an Initial Study for the project and posted a Negative Declaration <br /> for review. No significant'impacts were identified. As such, the proposal will not be <br /> significantly,detrimental to the public health, safety, or welfare, or be injurious to the <br /> property or improvements of adjacent properties. <br /> FINDING E. <br /> Compatibility of Use: The proposed residential use of the subject property is found <br /> to be compatible with nearby quarry operations because the State of California has <br /> specifically identified very low density residential use as being compatible with mining <br /> operations. <br /> CALIFORNIA MINERAL RESOURCE MANAGEMENT POLICIES <br /> Article 6 of the California Code of Regulations- <br /> Section 3675. Definitions <br /> The following definitions as used herein shall govern the interpretation of these <br /> regulations <br /> Compatible Land Use. Land uses inherently compatible with mining and/or <br /> that require a minimum public or private investment in structures, land improvements, <br /> and which may allow mining because of the relative economic value of the land and its <br /> improvements. Examples of such uses may include, but shall not be limited to very low <br /> density residential, geographically extensive but low impact industrial, recreational, <br /> agricultural, silvicultural, grazing, and open space. <br /> The proposed residential use of the subject property is further found to be compatible <br /> with nearby uses including mining as further described here. On July 3, 2008,the San <br /> Joaquin County Planning Commission approved the Lonestar California/Cemex project <br /> QX-01-02 for a quarry on 688 acres of land located approximately 450' east of the <br /> subject property and about 600' distant from the proposed residence. This quarry <br /> included adjacent residential uses closer to both the excavation and processing plant <br /> operations. The PIanning Commission found as follows with regard to compatibility: <br /> "The Commission finds that the project in conjunction.with past,present, and future <br /> development of adjacent areas would not have a significant or potentially significant <br /> effect on land use compatibility, agricultural productivity, or slope stability. After <br /> consideration of the impacts listed above (and in Section D.1 of these findings) the <br /> County concludes that the cumulative impacts listed in this section are less than <br /> significant when combined with other related projects and therefore require no <br /> mitigation. " <br /> The Initial Study and Negative Declaration prepared by planning staff concluded that <br /> there were no potential significant effects. In support of the finding by staff as contained <br /> in the Initial Study,the Plannning Commission further finds and supports the conclusions <br /> of the Initial Study as follows: <br /> 3 <br />
