Finding E. cont'd <br /> L . No quarry truck traffic is permitted to use that portion Koster adjacent to the <br /> residence. There are three quarry operations that have been approved in the <br /> vicinity of the proposed residence: Teichert (Triangle), DSS,and Cemex. <br /> Conditions of approval for these three quarries preclude the use of that portion of <br /> Koster Road south of the bridge over the Delta Mendota Canal. The Cemex haul <br /> route may only use a portion of Koster Road at a point at least 1,600 feet north of. <br /> the proposed house, and then continues north to Blewett Road.- The DSS quarry <br /> utilizes an access road to Blewett Road. The Teichert (Vernalis East Project) is <br /> subject to Conditions of Approval 2.c and 2.d. Condition(2.c)restricts the haul <br /> route to Bird Road and Condition 2.d use of conveyors or private haul roads for <br /> raw product. <br /> 2. Analysis of the existing and projected noise environment covering the subject <br /> property is contained in the EIRs prepared for the quarries referenced in <br /> paragraph A. above. (RMC Pacific Vernalis Quarry—now CEMEX <br /> SCH#2002122122; DSS Engineering Contractors proposed Koster Road Quarry <br /> Excavation SCH#96112069 and Environmental Noise Assessment DSS <br /> Reschedule of Hours of Operation, Bollard and Brennan, April 2002;Vernalis <br /> West and East Project SCH#2006022089) None of these documents suggest that <br /> the noise standards adopted by the County would not be met at the location of the <br /> proposed residence. The DSS processing plant noise is barely distinguishable <br /> from other background noise with a predicted Leq in the mid 40 decibels range <br /> (see Environmental Noise Assessment, Bollard &Brennan, April 2002). The <br /> proposed CEMEX processing plant is closer and the projected Leq is about 54 <br /> decibels, well within the maximum 65 dB Ldn allowed by San Joaquin County <br /> Code (9-1025.9). Bollard&Brennan also measured the noise generated by."belly <br /> » e of <br /> tenial at 65 dB Le at a distance scrapers used to excavate/remove the raw ma q <br /> 100 feet. Since the proposed home would be about 600' from the closest CEMEX <br /> excavation, based on a generally accepted worst case noise level reduction of 6db <br /> for every doubling of distance (see Bollard and Brennan),noise levels from <br /> CEMEX excavation operations would result in maximum Ldn of about 51 db. <br /> The DSS site excavation, although closer, is well below original grade and is <br /> separated by an earth berm planted with oleander. The presence of the berm <br /> alone would reduce the Ldn by 5 dB (See Bollard&Brennan) <br /> 3. Dust control is regulated by the San Joaquin Valley Air Pollution Control District <br /> (SJVAPCD). Specifically, quarry operations are subject to SJVAPCD Regulation <br /> VIII; are subject to dust control plans and monitoring. The adopted finding for <br /> the Cemex quarry concluded that the only significant and unavoidable cumulative <br /> impacts related to the existing and proposed quarries related to air quality and <br /> noise for residences located along the haul route. <br /> 4. Vibrations- Chapter 9-1025 of the San Joaquin County Development Title <br /> regulates vibrations as follows: °19-1025.5(a) Perceptible Displacement. No use <br /> shall cause any perceptible displacement at any lot line abutting any zone except <br /> an I-G Zane." <br /> 4 <br />
