Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Site Approval No. PA-1200122 with the Findings and Conditions of Approval contained
in the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan,
any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This Finding can be made because the Agricultural Waste use type may be conditionally
permitted in the AG-40 (General Agriculture, 40-acre minimum) zone with an approved Site
Approval application. The project site has a General Plan designation of A/G (General
Agriculture). There are no other applicable Master Plans, Specific Plans, Specific Plan,
Special Purpose Plans, or any other applicable plans which are within the vicinity of this
project.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This Finding can be made because the project will be required to be served by an on-site well
and septic system. Storm water drainage will be retained on-site.
3. The site is physically suitable for the type of development and for the intensity of development.
• This Finding can be made because the 32-acre parcel is of adequate size and shape to
accommodate the drying pads, setbacks, and requirements of the Development Title. The Site
Plan shows that there is sufficient area for parking and circulation, in compliance with
Standards of the Development Title.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be
injurious to the property or improvements of adjacent properties.
• This Finding can be made because the Initial Study prepared for the project found no
potentially significant environmental impacts. Implementation of the Odor Impact
Minimization Plan will ensure impacts to air quality are reduced to less than significant.
5. The use is compatible with adjoining land uses.
• This Finding can be made because the proposed use will not interfere with nor alter the
current land uses on adjacent properties. The nearest residence is located approximately 470
feet east of the project site. The land uses for the parcels along the perimeter are agricultural
with scattered residences and the parcel is buffered from uses to the north by Lammers Road
San Joaquin County PA-1200122/Gilton
Community Development Page 5
