Comments on the Wellhead Electric Project <br /> The original application for the Wellhead 49 Megawatt Peaker Project <br /> was processed under the Governors Four Month Expediated Review <br /> Process. This short review period limited public participation and led to <br /> many factual and legal errors in the original application review. These <br /> errors are substantive in nature and require a complete review of the project <br /> before an extension can be granted. <br /> The original approval was granted on April 18, 2001. At that time the <br /> parcel proposed for the project was still encumbered by the Williamson Act. <br /> The findings required to develop the parcel for non agricultural use were not <br /> made and State Law was violated by the applications approval at that time. <br /> In order to approve this application at that time the development department <br /> would have to make the findings that the projects benefits outweighed the <br /> projects impacts and that no other non-contracted land was available in the <br /> vicinity. These findings were not made. <br /> In the initial study several mistakes were made which materially affected <br /> the projects review.
