Comments on the Wellhead Electric Project
The original application for the Wellhead 49 Megawatt Peaker Project
was processed under the Governors Four Month Expediated Review
Process. This short review period limited public participation and led to
many factual and legal errors in the original application review. These
errors are substantive in nature and require a complete review of the project
before an extension can be granted.
The original approval was granted on April 18, 2001. At that time the
parcel proposed for the project was still encumbered by the Williamson Act.
The findings required to develop the parcel for non agricultural use were not
made and State Law was violated by the applications approval at that time.
In order to approve this application at that time the development department
would have to make the findings that the projects benefits outweighed the
projects impacts and that no other non-contracted land was available in the
vicinity. These findings were not made.
In the initial study several mistakes were made which materially affected
the projects review. Under the general considerations section of the initial
study all three questions were incorrectly answered.
1
F •d 6bEO0E66oa saOgs sRanJRs QIO : ri FO OT a❑
