Appeal Statement No.3: <br /> In his appeal statement, the appellant states the following: <br /> Screening: Community Development Item H <br /> "The church site has been approved for two buildings. One building 4,800 sq. ft., and the other 1,300 sq. ft., <br /> with a max. capacity of 120 persons. These buildings would completely obstruct all of our view of Mt. <br /> Diablo. Even worse than huge buildings blocking our view, is the approval of an ugly 6 to 7 ft. tall wall that <br /> would be erected where our view is now, all the way across our property between the church and our <br /> house." <br /> Response to Appeal Statement No.3: <br /> The maximum height of the church is 24 feet tall, as listed in the Site Approval Application. Development <br /> Title Section 9-310.6 states that buildings and structures in the residential zones shall not exceed the <br /> heights set forth in Table 9-310.3. Table 9-310.3 states that the maximum building height allowed in a <br /> residential zone is 35 feet. The height of the proposed church satisfies this height requirement as stated in <br /> the Development Title. <br /> Screening is required between commercial projects adjoining residential areas. Development Title Section <br /> 9-1022.4(d)(1) states that if a commercial project abuts a residential zone, an area shown on the General <br /> Plan for residential use, or an existing residential use, a solid masonry wall six(6)to seven (7)feet in height <br /> shall be erected along the abutting property line. <br /> Appeal Statement No.4: <br /> In his appeal statement, the appellant states the following: <br /> Lighting: Community Development Item F(2) <br /> "Light pollution, being able to sleep and shining in our windows, etc." <br /> Response to Appeal Statement No.4: <br /> Development Title Section 9-1015.5(g)(4) states that all lighting shall be designed to confine direct rays to <br /> the premises. No spillover beyond the property line shall be permitted, except onto public thoroughfares, <br /> provided, however, that such light shall not cause a hazard to motorists. <br /> Appeal Statement No.5: <br /> In his appeal statement, the appellant states the following: <br /> Septic System <br /> "Is there a perk test and haw's it going to work?" <br /> Response to Appeal Statement No.5: <br /> The Environmental Health Department has indicated that a perk test will not be required for this project <br /> because public water and sewer services will be utilized. <br /> San Joaquin County PA-0300116/People of Christ <br /> Community Development Page 4 <br />
