r RESOLUTION 165 <br /> APPROVING THE PROVISION OF CITY WATER SERVICE TO VACANT PARCELS IN THE <br /> LARCH CLOVER AREA <br /> WHEREAS, the Larch Clover area in unincorporated San Joaquin County is within the <br /> City of Tracy's Sphere of Influence, and <br /> WHEREAS, the City of Tracy agreed to provide water to the existing residents of the <br /> area to the degree set forth under an agreement between the City and the County dated August <br /> 5, 1986, and <br /> WHEREAS, in November of 2003, the property owners in the Larch Clover area formed <br /> an assessment district to provide City sewer service to the area, and <br /> WHEREAS, as a part of the district formation to implement sewer improvements, the <br /> City committed to provide water(One Equivalent Consumer Unit) upon payment of fees to <br /> vacant parcels upon annexation, and <br /> WHEREAS. the annexation application was rejected, and <br /> WHEREAS, there are a small number of property owners desiring to construct buildings <br /> that would require a potable water supply of no more than one Equivalent Consumer Unit <br /> (ECU). <br /> WHEREAS, the number of such residential units that could be constructed is no more <br /> than 30, and is limited to the following parcels: <br /> 212-170.08 212-190-12 <br /> 212-170-14 212-190-22 <br /> 212-170-16 212-190-26 <br /> 212-170-20 212-190-47 <br /> 212-170-26 212-190-49 <br /> 212-170-34 212-190-59 <br /> 212-170-38 212-260-04 <br /> 212-170-39 212-260-10 <br /> 212-170-43 212-260-21 <br /> 212-180-12 214-050-03 <br /> 212-180-14 214-050-05 <br /> 212-180-16 214-180-06 <br /> 212-180-23 214-160-07 <br /> 212-180-28 214-180-08 <br /> 212-190-02 214-180-36, and <br /> WHEREAS, provision or water service to no more than 30 residential units would have a <br /> minimal impact on the City's ability to provide water to the City as a whole, <br /> NOW, THEREFORE BE IT RESOLVED That the City Council finds that the provision of <br /> water to vacant properties within the Larch Clover area is consistent with the agreement <br /> between the City of Tracy and the County of San Joaquin approved August 5. 1986 if the <br /> following criteria are met: <br /> M-d C00/100 d 001-1 011>ICHOZI ADM d0 A110-Wo+i C0'01 9002-IC-150 <br /> zoo 'd 801 S£8 60Z:131 ONI '00 1 MHOS D11 (3R1)90 ,1£- .100 <br />
