The project <br /> consists of a Variance application to permit removal of 297, 600 <br /> cubic yards of soil. The project is located at the north end of <br /> Kennefick Road north of Lodi in San Joaquin County. <br /> The DFG has responded to an earlier Use Permit for this <br /> project. In our response to the Use Permit we requested that the <br /> loss of Swainson' s hawk (Buteo swainsonii) foraging habitat be <br /> mitigated based on DFG' s, Mitigation Guidelines for Swainson' s <br /> hawk in the Central Valley of California. <br /> We would like to use this opportunity to restate our concern <br /> that the loss of Swainson' s hawk foraging habitat be off-set. <br /> Pursuant to Public Resources Code Sections 21092 and <br /> 21092 . 2, the DFG requests written notification of the proposed <br /> actions and pending decisions regarding this project.
