w� J <br /> San Joaquin Valley <br /> Air Pollution Control District <br /> •,i�`clir�t�; <br /> APR 2 <br /> April 20, 2000uCyCf4,Z��O <br /> Kai Luoma <br /> San Joaquin County <br /> Community Development Department <br /> Development Services Division <br /> 1810 East Hazelton Avenue <br /> Stockton, CA 95205 <br /> SUBJECT: UP 00-5 (PRE-APPLICATION) KELLOGG GARDEN PRODUCTS <br /> Dear Mr. Luoma:•• <br /> The San Joaquin Valley Air Pollution Control District (District) has reviewed the proposed <br /> project and offers the following comments: <br /> The San Joaquin Valley's air quality has been designated nonattainment by the EPA and by <br /> the Air Resources Board (ARB) for 03 (ozone) and PM-10 (fine particulate matter, dust). <br /> The Federal Clean Air Act (CAA) and the California Clean Air Act require areas that are <br /> designated nonattainment to reduce emissions until standards are met. <br /> It appears as if the operational phase of this project would generate emissions from the <br /> movement of soil, use of heavy equipment, bulk materials handling, and other related <br /> activities. As a result, this project is subject to District Regulation VIII (Fugitive Dust <br /> Prohibitions). The purpose of Regulation VIII is to reduce the amount of fine particulate <br /> matter (PM-10) entrained into the ambient air from man-made sources. The attached <br /> Synopsis highlights many of the requirements contained within Regulation VIII. The <br /> Synopsis is not meant to be all-inclusive, but it can be a useful compliance aid in the field <br /> and office alike. Currently District staff is in the process of holding work shops regarding <br /> changes to Regulation VIII, the applicant should contact the District if they wish to be <br /> included in this process <br /> This facility would be subject to District Rule 4102 (Nuisance). The purpose of this rule <br /> is to protect the health and safety of the public and applies to any source operation <br /> which emits or may emit air contaminants or other material. A possible violation could <br /> occur if the project proponent discharges quantities of air contaminants which cause the <br /> following nuisances: <br /> David L.
