San Joaquin County April 20, 2000
UP-00-5 Kellogg Garden Product Page 2
• Injury, detriment, or annoyance to any considerable number of persons or to the
public.
• Endangers the comfort, repose, health, or safety of any such person or the public.
• Has a natural tendency to cause injury or damage to business or property.
In addition, this project may contain operations which are subject to the permitting
requirement of the District. Any equipment subject to the District's Permit to Operate
requirements must obtain an Authority to Construct (ATC) from the District. Construction of
equipment that requires an ATC or construction of any intimately related appurtenance,
such as foundatioMs and utility hookups for equipment, cannot begin until an ATC is
obtained. This process can take up to 180 days. Construction of equipment not requiring a
District permit is not subject to this ATC requirement.
To determine specific permit requirements, the applicant should contact the District's Small
Business Assistance Office at (209) 557-6446, or our Permit Services Section at (209) 557-
6400. To avoid unnecessary delays in the project, this should be done as soon as the
applicant has determined the scope of the project.
Finally, due to the annual trip rate of heavy-duty diesel equipment (4000 trips per year) the
applicant should provide emission estimates for this equipment. The California Air
Resources Board has identified emissions produced by the diesel powered equipment
as a toxic air contaminant. Action should be taken to reduce emissions from the
equipment. The District operates a Heavy-Duty Vehicle Incentive Program that
provides funds for the differential cost of lower emission engines compared to a
conventional diesel engine.
Thank you for the opportunity to comment. If you have any questions, please feel free to
contact me at (209) 557-6400.
Sincerely,
John Cadrett
Environmental Planner APCD REF#20000073
Northern Region
