September 1, 2005 District Reference No. N20050548 Kathy Allen San Joaquin County Community Development Department 1810 East Hazelton Avenue Stockton, CA 95205 Re: Revised Project Description for Site Approval for Application Number PA-0500361 (SA) Frank Rocha Dairy Dear Ms. Allen, The San Joaquin Valley Unified Air Pollution Control District(District) has reviewed the revised project description for the project referenced above and offers the following comments: The San Joaquin Valley's air quality has been designated nonattainment by the EPA and by the Air Resources Board (ARB) for ozone and fine particulate matter(PM10). The Federal Clean Air Act (CAA) and the California Clean Air Act require areas that are designated nonattainment to reduce emissions until standards are met. After reviewing the revised project description, this project will be exempt from further CEQA analysis by the District if the number of head of cows/animal types remains the same as the existing operation. This project will still be required to obtain an "Authority to Construct" (ATC) and a "Permit to Operate" (PTO) from the District. An ATC must be obtained before building a project that requires a permit. The PTO is issued after all construction is completed. Based on the information provided, the proposed project will be subject to the following District rules. The following items are rules that have been adopted by the District to reduce emissions throughout the San Joaquin Valley, and are required. This project may be subject to additional District Rules. To identify additional rules or regulations that apply to this project, or for further information, the applicant is strongly encouraged to contact the District's Small Business Assistance Office at (559) 230-5888. Rule 2201 (New and Modified Stationary Source Review Rule) This rule applies to all new stationary sources and all modifications of existing stationary sources which are subject to the District permit requirements and after construction emit or may emit one or more affected pollutant.
