Ms. Kathy Allen September 1, 2005 <br /> Administrative Application No. PA-0500361 (SA) Page 2 <br /> Frank Rocha Dairy <br /> • Regulation VIII (Fugitive PM10 Prohibitions)- Regulation VIII (Rules 8011-8081) is a series <br /> of rules designed to reduce PM 10 emissions (predominantly dust/dirt) generated by human <br /> activity, including construction, road construction, bulk materials storage, landfill operations, <br /> etc. <br /> If a non-residential project is 5.0 or more acres in area, a Dust Control Plan must be <br /> submitted as specified in Section 6.3.1 of Rule 8021. If a non-residential site is 1.0 to less <br /> than 5.0 acres, an owner/operator must provide written notification to the District at least 48 <br /> hours prior to his/her intent to begin any earthmoving activities(see section 6.4.2). It will require the preparation of a CMP Plan <br /> that must be submitted to the District. <br /> • Rule 4641 (Cutback, Slow Cure, and Emulsified Asphalt, Paving and Maintenance <br /> Operations). If asphalt paving will be used, then paving operations of this project will be <br /> subject to Rule 4641. This rule applies to the manufacture and use of cutback asphalt, slow <br /> cure asphalt and emulsified asphalt for paving and maintenance operations. <br /> District staff is available to meet with you and/or the applicant to further discuss the regulatory <br /> requirements that are associated with this project.
