All new and replacement water supply and sanitary sewage systems shall be designed to minimize <br /> or eliminate infiltration of flood waters into the system and discharge for systems into flood waters. <br /> (Development Title Section 9-1605.13 (a)) <br /> 4. Waste disposal systems shall be located to avoid impairment to them or contamination from them <br /> during flooding. (Development Title Section 9-1605.13 (b)) <br /> 5. All structures within the floodways shall be constructed as to remain in place during the one <br /> hundred(100)year flood, except those subject to an Evacuation plan as specified in chapter 9-845. <br /> (Development Title Section 9-1605.16(a)) <br /> 6. All Structures shall be designed to allow free passage of floodwaters and minimize catching of <br /> debris. (Development Title Section 9-1605.16(b)) <br /> 7. All moveable equipment and stored material shall be removed prior to a flood. (Development Title <br /> Section 9-1605.16(e)) <br /> 8. Any encroachments, in the floodway, including fill new construction, substantial improvements, <br /> and other development shall be prohibited unless certification is provided by a registered civil <br /> engineer demonstrating that encroachments will not result in any increase in flood levels during the <br /> occurrence of the one hundred(100)year flood discharge. (Development Title Section 9- <br /> 1605.16(g)) <br /> 9. The following uses shall be prohibited within flood ways. (Development Title Section 9- <br /> 1605.17(a)): <br /> a) Storage of hazardous materials, including but not limited to pesticides,radioactive <br /> materials, explosives, and other materials which may be hazardous to life, limb,or <br /> property when inundated; <br /> b) Mobil homes and recreational vehicles not within parks with approved evacuation plans; <br /> c) Double'-wide mobile homes of expando mobile homes; <br /> d) New.cemeteries or expansion of existing cemeteries; <br /> e) New Sanitary landfills or expansion of existing sanitary landfills; <br /> f) Water wells; and <br /> g) Sewage wastewater facilities. <br /> 10. The public road portion of West Lorenzen Road is acknowledged as a low volume narrow rural <br /> agricultural dead end road that is not constructed for the sustained high volume traffic.The road is <br /> currently exhibiting structural problems,and San Joaquin County does not commit to maintain this <br /> road to a higher standard to accommodate the proposed or future uses of the property. Property <br /> owner shall provide San Joaquin County a written statement acknowledging the above and that <br /> property owner agrees disclose the above to any future potential buyers of the property. <br /> 11. The Traffic Impact Mitigation Fee shall be required for this development. The fee is due and <br /> payable at the time of building permit application. The fee shall be automatically adjusted July I <br /> of each year by the Engineering Construction Cost Index as published by the Engineering News <br /> Record. (Resolution R-00-433) <br />
