CONDITIONS OF APPROVAL <br /> GX-96-4 <br /> McKee <br /> Agricultural Excavatlon Aonlication No.GX-96-4 was approved by the San Joanuin County Commuribt <br /> Development Department on December 9, 1996. The effective date of approval is December 19, <br /> 1996. This approval will expire on June 20, 1998, which Is 18 months from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with and (2) all necessary permits <br /> from other agencies have been secured and remain In force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Chandler Martin, 468-3190) <br /> a. WRITTEN NOTIFICATION/IMPROVEMENT PLAN: A written notification of work <br /> schedules and an Improvement Plan shall be provided by the applicant and approved by <br /> the County prior to any grading or excavation. The Improvement Plan shall reflect all of <br /> the adopted Conditions of Approval. One copy of the Improvement Plan shall be <br /> submitted to the Development Services Division for distribution to the involved County <br /> departments. A plan check fee will be required. (Development Title Section 9-1410.301) <br /> b. PERFORMANCE GUARANTEE: To ensure that the excavation is completed in <br /> conformance with the approved permit, the operator shall secure a performance bond or <br /> other financial security sufficient to cover the cost of rehabilitation of the site for <br /> agricultural use. The form of the bond or other financial security shall be found <br /> acceptable by Community Development Department and County Counsel. The <br /> performance guarantee for a given phase may be released after a Certificate of <br /> Completion is approved for that phase. (Development Title Section 9-1410.2[m]) <br /> C. PHASING: The project shall be excavated and completed in five phases in the order <br /> shown on, and in accordance with, the Plan submitted October 30, 1996. The applicant <br /> shall notify the Community Development Department in writing prior to beginning each <br /> new phase. A Certification of Compliance is required at the completion of each phase. <br /> Excavation of a phase may begin while one previous phase is being rehabilitated and <br /> certified. <br /> The engineer/surveyor of record shall submit inspection reports at 50% and 75% stages <br /> of completion by volume for each phase which will certify that the excavation is in <br /> conformance with the approved plans. No material is to be removed from the site until <br /> the Certificate of Compliance is accepted and approved for Phase I. <br /> Records shall be kept of the volumes of material being removed from site. A summary <br /> of those records shall accompany each inspection report. <br /> Conditions of Approval - 1 - GX-96-4 <br />
