CONDITIONS OF APPROVAL GX-96-4 McKee Agricultural Excavatlon Aonlication No.GX-96-4 was approved by the San Joanuin County Commuribt Development Department on December 9, 1996. The effective date of approval is December 19, 1996. This approval will expire on June 20, 1998, which Is 18 months from the effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) all necessary permits from other agencies have been secured and remain In force. Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to the establishment of the use. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Chandler Martin, 468-3190) a. WRITTEN NOTIFICATION/IMPROVEMENT PLAN: A written notification of work schedules and an Improvement Plan shall be provided by the applicant and approved by the County prior to any grading or excavation. The Improvement Plan shall reflect all of the adopted Conditions of Approval. One copy of the Improvement Plan shall be submitted to the Development Services Division for distribution to the involved County departments. A plan check fee will be required. (Development Title Section 9-1410.301) b. PERFORMANCE GUARANTEE: To ensure that the excavation is completed in conformance with the approved permit, the operator shall secure a performance bond or other financial security sufficient to cover the cost of rehabilitation of the site for agricultural use. The form of the bond or other financial security shall be found acceptable by Community Development Department and County Counsel. The performance guarantee for a given phase may be released after a Certificate of Completion is approved for that phase. (Development Title Section 9-1410.2[m]) C. PHASING: The project shall be excavated and completed in five phases in the order shown on, and in accordance with, the Plan submitted October 30, 1996. The applicant shall notify the Community Development Department in writing prior to beginning each new phase. A Certification of Compliance is required at the completion of each phase. Excavation of a phase may begin while one previous phase is being rehabilitated and certified. The engineer/surveyor of record shall submit inspection reports at 50% and 75% stages of completion by volume for each phase which will certify that the excavation is in conformance with the approved plans. No material is to be removed from the site until the Certificate of Compliance is accepted and approved for Phase I. Records shall be kept of the volumes of material being removed from site.
