d. REPLACEMENT OF TOPSOIL: During the excavation of each phase, the topsoil shall be set aside. Upon completion of excavation of each phase, the topsoil shall be replaced and the site leveled in conformance with the approved Grading Plan. (Development Title Section 9-1410.3[g]) e. STOCKPILING REQUIRED: All excavated material from each phase shall be stockpiled on the sue and snail not be removed from the site until acceptance and approval of the inspection report for that phase. Excavated material shall be stockpiled and set back at least 25 feet from any property line or road right-of-way. (Development Title Sections 9- 1410.3[g] and [m]) f. PERMIT EXPIRATION: All Conditions of Approval shall be complied with, excavation shall be completed, and final rehabilitation of the site shall be completed prior to October 15, 1997. (Development Title Section 9-215.14) g. FINAL GRADE/SLOPE: The average finished grade elevation shall be no lower than 8.6 feet, which is the average surrounding elevation as shown on the Plan submitted October 30, 1996. The final slope shall be no greater than .0020 ft/ft. The final elevation at the limit of excavation adjacent to the pipeline shall be no lower than 10.35 feet. (Development Title Section 9-1410.3[b][41) h. AIR QUALITY: The following regulations apply: (1) All private roads involved in an excavation shall be maintained so as to control the creation of dust. Dust control measures shall be indicated on the Improvement Plans. (Planning Title Section 9-1410.3[a]) (2) All emissions shall be subject to the rules and regulations of the San Joaquin Valley Unified Air Pollution Control District. (Development Title Section 9- 1410.3[f]) i. HOURS OF OPERATION: Excavation operations shall not be carried on during the hours from 9:00 p.m. through 5:00 a.m., except during periods of declared national, state, or local emergency. (Development Title Section 9-1410.3[d]) j. WEED CONTROL: If noxious weeds are on the site, operations shall be in accordance with instructions from the Agricultural Commissioner of San Joaquin County. (Development Title Section 9-1410.3[h]) k. LIGHTING: Any night lighting established on the property shall be arranged and controlled so as not to illuminate public rights-of-way or adjacent properties. (Development Title Section 9-1410.3[e]) I. HEALTH CONSIDERATIONS: Excavations shall not cause health or sanitary hazards and shall not create conditions which will cause the breeding or increase of mosquitos, rodents, or other pests.
