d. REPLACEMENT OF TOPSOIL: During the excavation of each phase, the topsoil shall <br /> be set aside. Upon completion of excavation of each phase, the topsoil shall be replaced <br /> and the site leveled in conformance with the approved Grading Plan. (Development Title <br /> Section 9-1410.3[g]) <br /> e. STOCKPILING REQUIRED: All excavated material from each phase shall be stockpiled <br /> on the sue and snail not be removed from the site until acceptance and approval of the <br /> inspection report for that phase. Excavated material shall be stockpiled and set back at <br /> least 25 feet from any property line or road right-of-way. (Development Title Sections 9- <br /> 1410.3[g] and [m]) <br /> f. PERMIT EXPIRATION: All Conditions of Approval shall be complied with, excavation <br /> shall be completed, and final rehabilitation of the site shall be completed prior to October <br /> 15, 1997. (Development Title Section 9-215.14) <br /> g. FINAL GRADE/SLOPE: The average finished grade elevation shall be no lower than 8.6 <br /> feet, which is the average surrounding elevation as shown on the Plan submitted October <br /> 30, 1996. The final slope shall be no greater than .0020 ft/ft. The final elevation at the <br /> limit of excavation adjacent to the pipeline shall be no lower than 10.35 feet. <br /> (Development Title Section 9-1410.3[b][41) <br /> h. AIR QUALITY: The following regulations apply: <br /> (1) All private roads involved in an excavation shall be maintained so as to control <br /> the creation of dust. Dust control measures shall be indicated on the <br /> Improvement Plans. (Planning Title Section 9-1410.3[a]) <br /> (2) All emissions shall be subject to the rules and regulations of the San Joaquin <br /> Valley Unified Air Pollution Control District. (Development Title Section 9- <br /> 1410.3[f]) <br /> i. HOURS OF OPERATION: Excavation operations shall not be carried on during the <br /> hours from 9:00 p.m. through 5:00 a.m., except during periods of declared national, state, <br /> or local emergency. (Development Title Section 9-1410.3[d]) <br /> j. WEED CONTROL: If noxious weeds are on the site, operations shall be in accordance <br /> with instructions from the Agricultural Commissioner of San Joaquin County. <br /> (Development Title Section 9-1410.3[h]) <br /> k. LIGHTING: Any night lighting established on the property shall be arranged and <br /> controlled so as not to illuminate public rights-of-way or adjacent properties. <br /> (Development Title Section 9-1410.3[e]) <br /> I. HEALTH CONSIDERATIONS: Excavations shall not cause health or sanitary hazards <br /> and shall not create conditions which will cause the breeding or increase of mosquitos, <br /> rodents, or other pests.
