PERMIT EXPIRATION: All Conditions of Approval shall be complied with, excavation shall be completed, and final rehabilitation of the site shall be completed prior to September 30, 1997 . (Development Title Section 9-215. 14) g. FINAL GRADE: The average finished grade elevation shall be no lower than 8. 81 feet and shall. The finished elevations shall be as shown on the Plan submitted June 10, 1996. (Development Title Section 9-1410. 3 [b] [4] ) h. AIR QUALITY: The following regulations apply: (1) All private roads involved in an excavation shall be maintained so as to control the creation of dust. Dust control measures shall be indicated on the Improvement Plans. (Planning Title Section 9-1410 . 3 [a] ) (2) All emissions shall be subject to the rules and regulations of the San Joaquin Valley Unified Air Pollution Control District. (Development Title Section 9-1410. 3 [f] ) i. HOURS OF OPERATION: Excavation operations shall not be carried on during the hours from nine (9) p.m. through five (5) a.m. , except during periods of declared national, state or local emergency. (Development Title Section 9-1410. 3 [d] ) j . WEED CONTROL: If noxious weeds are on the site, operations shall be in accordance with instructions from the Agricultural Commissioner of San Joaquin County. (Development Title Section 9-1410. 3 [h] ) k. LIGHTING: Any night lighting established on the property shall be arranged and controlled so as not to illuminate public rights-of-way or adjacent properties. (Development Title Section 9-1410. 3 [e] ) 1. HEALTH CONSIDERATIONS: Excavations shall not cause health or sanitary hazards and shall not create conditions which will cause the breeding or increase of mosquitos, rodents, or other pests. (Development Title Section 9-1410 . 3 [ i] ) M. CERTIFICATION OF COMPLIANCE: At the completion the of the grading, and at the completion of each phase, the applicant shall have a registered civil engineer or licensed land surveyor compare the excavation's final elevations with the approved permit. The engineer or surveyor shall submit a certified, written finding to the Development Services Division which states and documents the compliance or non-compliance of the excavation with all of the conditions of the approved permit.
