Item No. 3 <br /> PC: 7-15-93 <br /> -, UP-93-2 <br /> Page 3 <br /> CERTIFICATION OF THE FINAL EIR <br /> Based upon a preliminary environmental determination by the Solid Waste Division of the Department of <br /> Public Works that the project had the potential to result in potentially significant, adverse enviromental <br /> impacts, an Environmental Impact Report (EIR) was prepared for the project by Baracco and Associates <br /> under contract to the Department of Public Works. The EIR addressed the following issues: land use, <br /> traffic and circulation, public services and facilities, ground relief features, seismicity, water quality, air <br /> quality, noise, biotics, cultural resources, light and glare, visual quality, and hazardous materials. Each <br /> of these issues for which potentially significant impacts were identified is discussed in the staff report <br /> under 'Discussion of Project Issues.' <br /> Staff from the Department of Public Works and the Community Development Department conducted <br /> hearings on the Draft EIR for the public and the Planning Commission on May 26 and June 3, 1993, <br /> respectively. The minutes of those meetings have been incorporated into the Final EIR, along with <br /> responses by the EIR consultant to comments made at the hearings. All other oral and written comments <br /> received during the 45-day review period for the Draft EIR have also been responded to and included in <br /> the Final EIR. Where necessary, the text of the draft document has been amended as a result of the <br /> public review process. Final EIRs were distributed to the Planning Commission on July 1, 1993, with <br /> copies and/or notices of availability to interested persons, organizations, and local agencies on July 2, <br /> 1993. <br /> DETERMINATION OF ADEQUACY OF THE FINAL ENVIRONMENTAL IMPACT REPORT: <br /> The only determination to be made by the Commission in order to certify the EIR is whether or not it is <br /> adequate as described in Section 15151 of CEQA. This section states in part that 'an EIR should be <br /> prepared with a sufficient degree of analysis to provide decision makers with information which enables <br /> them to make a decision which intelligently takes account of environmental consequences. An evaluation <br /> of the environmental effects of a proposed project need not be exhaustive, but the sufficiency of an EIR <br /> is to be reviewed in the light of what is reasonably feasible.' <br /> It is staff's determination that the EIR meets the intent of this section. The document thoroughly discusses <br /> all issues presented in the Initial Study, contains all sections required by law, and adheres to all review <br /> periods and time requirements. All issues raised during the review of the draft document are thoroughly <br /> discussed in the Final EIR. <br />
