Though the Dutras' are not opposed to the project, they are <br /> concerned with potential conflicts between their agricultural use of their land, and the proposed <br /> project. <br /> The following are issues that must be addressed by the applicant: <br /> 1. There must be a recognition of the agricultural use of my client's land. Thus, <br /> appropriate safeguards ensuring that conflicts with agricultural spraying and agricultural practices <br /> do not create problems between my clients and the applicants parishioners and others using the <br /> project site. (ie hold harmless/other form of agreement) <br /> 2. Appropriate fencing must be installed along the northern property line of the project <br /> site to ensure that no-one trespasses onto the Dutras' property. The applicant must be <br /> advised that the Dutras' existing fence has a hot electrical wire to keep the cattle from pushing up <br /> against the fence. If someone was to try to jump the fence, there is a strong likely hood that they <br /> could receive an un-welcomed electrical charge. <br /> 3. In addition to the fencing, proper screening of the batting cages, baseball back stop <br /> and play areas, must be installed to ensure that balls of all types are not hurled onto the Dutras' <br /> property. During the prior use of the property, the Dutras' have had to contend with numerous <br /> golf balls and baseballs on their property. These balls have and can create problems with <br /> harvesting machinery to the point of causing breakdowns. <br />
