A view of the area indicates that new residential uses <br /> are being developed in the area to the immediate north of the property. Future urban growth is <br /> likely to develop in the area in the near-term future. Nevertheless, the applicant proposes to retain <br /> most of its land in agriculture at present. <br /> Although concerns were previously expressed, the applicant has met with its agricultural <br /> neighbors, discussed the project with them, and has signed agreements with neighboring <br /> agricultural uses in which it waives any claims against agricultural activities that may have an <br /> adverse impact on the proposed use in the future. Those neighbors concerns have been addressed <br /> and satisfied and they now support it. <br /> Applicant Has Satisfied All Requirements <br /> This applicant has satisfied all requirements that have been proposed by Staff. The mitigations and <br /> conditions proposed for the use permit reduce all the impacts of the project to a less than <br /> significant level. The project will have minor traffic impacts. The property has been determinedto <br /> be a clean site. The site plan minimizes the impact to agricultural land and agreements recognize <br /> the neighbors' right to farm. Revisions to the site plan have made the project compatible with uses <br /> in the area, particularly in light of the future urbanization planned within the sphere of influence of <br /> the City of Lodi. <br /> We urge approval of the negative declaration and the project tonight and will work with staff to <br /> assure that all conditions and mitigations you choose to impose are faithfully implemented. <br /> Yours very truly, <br /> STEVEN P.
