Analysis <br /> Background <br /> On December 3, 2003, a Use Permit application was submitted for a religious assembly and a K-4 grade school <br /> with a maximum of fifty (50) students. The application was approved by the Planning Commission on July 21, <br /> 2005. An appeal to the Board of Supervisors was filed July 27, 2005. The Board of Supervisors upheld the <br /> appeal, which denied the project on September 27, 2005, stating they could not make Findings 3, 4, and 5 in the <br /> affirmative. The Board of Supervisors had concerns regarding the school, location of the project on the southern <br /> portion of the parcel, and traffic safety. The Board of Supervisors were concerned that standard farming <br /> practices could be harmful to the children attending the school. The Board of Supervisors had a concern about <br /> the proximity of the religious assembly to the nearby residences along the southern property line. Traffic safety <br /> was also a concern regarding the adequacy of Lower Sacramento Road to accommodate the increased traffic <br /> from the school There were also safety concerns regarding left turns out of the project site onto Lower <br /> Sacramento Road. <br /> The project has been redesigned to address the issues identified by the Board of Supervisors. A school is not <br /> being proposed with this project. This project is located on the northern border of the parcel adjacent to a <br /> landscaping business, more than 500 feet from the southern property line. The Department of Public Works has <br /> made improvements to Lower Sacramento Road. Improvements include a median which runs directly in front of <br /> the relocated project site prohibiting left hand turns from the project site; the road has been widened from two <br /> lanes to four lanes just north of the project. A supplement to the original traffic study was also completed and the <br /> mitigation measures are included with Public Works'Conditions of Approval. <br /> Pursuant to Development Title Section 9-215.15 a previously denied project can be resubmitted after one (1) <br /> year. <br /> Church Operations <br /> Daily worship services will consist of five(5)services a day seven(7)days a week from 5:00 am to 10:00 pm with <br /> an expected maximum attendance of 50 people per service. The Friday worship begins at 1:00 pm and lasts <br /> until 2:30 pm with an expected maximum attendance of 200 people <br /> There is no school facility proposed. <br /> Neighborhood Opposition <br /> The Community Development Department received three (3) fetters of opposition, two from neighbors and one <br /> from the Farm Bureau. The letters expressed concerns regarding increased traffic, noise, excessive light, <br /> increased crime, and land use <br /> Traffic: As part of the review of the proposed project the Public Works Department required that a supplemental <br /> traffic impact analysis be performed. The original traffic analysis was prepared on June 16, 2004, and a <br /> supplemental traffic impact analysis was prepared on February 9, 2009, by Dowling Associates. The <br /> supplemental analysis-recommended the following two mitigation measures to reduce the impact of the proposed <br /> project. <br /> The owner shall pay the County $150.00 for the installation of a "No U-turn" sign facing southbound N. <br /> Lower Sacramento Road traffic at the end of the median south of the site. <br /> San Joaquin County PA-0800259/California Islamic Center <br /> Community Development Page 3 <br />
