Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Major Subdivision No. PA-0400074 with the Findings and Conditions of Approval
contained in the staff report.
Findings
1. The proposed subdivision is consistent with the General Plan, any applicable Master Plan, Specific
Plan, and Special Purpose Plan and any other applicable plan adopted by the County.
• This finding can be made because the parcels have a General Plan designation of RIR
(Rural Residential). As such, the proposed project is consistent with the General Plan and
Development Title. There are no Specific Plans or Special Purpose Plans. As required by
the Public Works Department, a Master Plan for a water system shall be prepared prior to
approval of the Final Map.
2. The design or improvement of the proposed subdivision is consistent with the General Plan and any
applicable Specific Plan or Special Purpose Plan.
• This finding can be made because the design and improvement of the proposed
subdivision are consistent with standards contained in the General Plan as reflected in the
tentative map. The water, and storm drainage services will be constructed by the
applicant and maintained by the Department of Public Works (CSA#29). As required,
engineer designed septic systems are to be installed under permit and inspection with he
Environmental Health Department. There are no Specific Plans or Special Purpose Plans.
3. The site is physically suitable for the type of development proposed.
• This finding can be made because the tentative map is consistent with the General Plan
density requirement of 1 to 5 dwelling units per five gross acres (1-5 dul5ga). The tentative
map is also consistent with the Development Title, which states that the lot width of
individual lots in a Major or Minor Subdivision may be reduced to seventy percent (70%) of
the minimum lot width required [150 feet] provided the following conditions are met: (1)
The average lot width for all lots in the proposed subdivision shall be equal to or greater
than the minimum lot width required (average lot width is 171 feet); and (2) Individual
corner lots shall not have a lot width of less than fifty (50) feet (Development Title Section
9-310.4). All other development requirements contained in the Development Title and
County standards are otherwise satisfied.
San Joaquin County PA-04000741Gudel
Community Development Page 7
COPY
