i
1
4. The site is physically suitable for the proposed density of development.
• This finding can be made because the number of parcels proposed is consistent with the
RIR General Plan density requirement of 1-5 dwelling units per five gross acres. The
average lot size is greater than one acre-and the entire project area:[excluding the
"designated remainder='] is 75.08 acres,which results in a density of less_Phan 1 dulga.
The "designated remainder" is not currently proposed for development.
5. Neither the design of the'subdivisian nor any proposed improvements are likely.tocause'substaritial
environmental damage or substantially and avoidably injure fishor wildlife or their habitat.
• This finding can be made because the applicant has decided to participate in the'San
Joaquin CounciI.of Governments Mule 606i ies.Habrtat`G,onservation and Open'Space
Plan.(SJMSCP) which will reduce impacts to biological resources resuitiig'from`the
proposed project to a levet of less4hari'-significant.
6. The design of the subdivision or type of improvement is not likely to cause significant public health
problems.
• This finding can be made because the Environmental Health-Department conditions
attached to the approval will address potential public health problems.
7. The design of the subdivision or the types of improvements will not conflict with easements acquired
by the public at large for access through or use of property within the proposed subdivision.
• This finding can be made because there are no.public easements.within the subdivision.
8. Any land or irnprovements to be dedicated to the County or other public agency is consistent with the
General Plan, any applicable Specific Plan and Special Purpose Plan, and any other applicable plan
adopted by the County.
i
• This finding can be made because all land and improvements to be dedicated to the
County are consistent with the General Plan and any other applicable plan adopted by the
County. There is no Specific Plan or Special Purpose Plan in the project vicinity.
Specifically, the Department of Public Works is requiring as a condition of approval that
the applicant dedicate an additional right of way of liberty Road and Lower Sacramento
Road to the County and improve it to County Standards for arterial roads, install street
lighting within the subdivision and on the frontage of Liberty Road and Lower Sacramento
Road, and dedicate ground water rights.
9. The design of the subdivision provides, to the extent feasible, for future passive or natural heating or
cooling opportunities in the subdivision, as required by Government Code Section 66473.1.
This finding can be made because the lots are large enough so that individual dwellings
can be situated to take advantage of solar orientation.
San Joaquin County PA-04000741Gudel
Community Development Page 8
COPY
