(Development Title Section 9-1505.4[d]) • The Review Authority may require, as a Condition of Approval, the applicant to provide a performance bond or other financial security to replant any replacement tree found not to be alive at the end of the required three (3) year maintenance period. The applicant may be required to provide additional security to ensure maintenance of said trees for an ensuing three (3) year maintenance period (Development Title Section 9-1505.4[e]). To protect and preserve heritage oak trees and native oak trees from development and construction activity the following recommended conditions of approval have been prepared. TREE PRESERVATION: The subdivision improvement plan shall indicate whether or not the tree will be removed. If the tree is to be removed, the method of replacement shall be described, consistent with Section 9-1504.4 of the Development Title. If the tree is to remain, development constraints shall be noted on the subdivision plans, consistent with Section 1505.5 of the Development Title. 3
