STOCKTON COUNTY OF SAN JOAQUIN <br /> 4 ROPOL/TAN DEPARTMENT OF AVIATION <br /> Z511�UIA PORT Dan DeAngelis <br /> Airport Manager <br /> January 19, 1996 <br /> Mr. Richard Larrouy, Assistant Planner <br /> San Joaquin County Planning Division <br /> 1810 East Hazelton Avenue �� <br /> Stockton, CA 95205 �"''n '-T _ <br /> Subject: Pre-Application No: SA-96-1 <br /> 22 1996 <br /> A I` <br /> Applicant: Loveminda Mendoza & Maria Manipol .0MMUNIIY Ut tWrtvitiVI btrl, <br /> 3172 westcreek Drive PLANNING DIVISION <br /> Stockton, CA 95209 <br /> Dear Mr. Larrouy: <br /> The San Joaquin County Department of Aviation (Stockton Metropolitan Airport) , has <br /> reviewed the above-referenced Pre-Application with respect to those areas germane to the <br /> operations of the Stockton Metropolitan Airport. <br /> Although the 65 db "community noise equivalent level" (CNEL) contours for Stockton <br /> Metropolitan Airport do not extend over the proposed project, this area may be subjected <br /> to the "single event noise exposure level" (SENEL) as this project is located in an area <br /> which is subjected to periodic overflight and resultant noise which was ascertained from <br /> field monitoring of both military and civil aircraft operations. <br /> Accordingly, the Department of Aviation is recommending that as a condition of approval, <br /> County Planning require the applicant to grant a Deed of Avigation and Hazard Easement to <br /> the County to protect the operational environs of the Stockton Metropolitan Airport, now <br /> and for the future. <br /> Enclosed for the project application package is a Deed of Avigation and Hazard Easement. <br /> The intent of such easement is to grant to the County a perpetual, assignable easement <br /> permitting overflight of the property by aircraft, together with any inherent noise or <br /> other emissions which are inherent in the operation of aircraft. The easement should be <br /> recorded as a deed restriction and/or C.C.& R's (Covenants, Conditions and Restrictions) <br /> applicable to the property flawing in perpetuity to all successor property owners. <br /> If you should require further information or clarification regarding our recommendations, <br /> please do not hesitate to contact me.
