As a result, this project is subject to District Regulation VIII
(Fugitive Dust Prohibitions). The purpose of Regulation V141 is to reduce the amount of
fine particulate matter (PM-10) entrained into the ambient air from man-made sources.
The attached Synopsis highlights many of the requirements contained within Regulation
VIII. The Synopsis is not meant to be all-inclusive, but it can be a useful compliance aid
in the field and office alike.
In addition, this project may be subject to the permitting requirements of the District.
Any equipment subject to the District's Permit to Operate requirements must obtain an
Authority to Construct (ATC) from the District. Construction of equipment that requires
an ATC, such as foundations and utility hookups for the equipment, cannot begin until
an ATC is obtained. This process can take up to 180 days. Construction of equipment
not requiring a District permit is not subject to this ATC requirement.
To determine if this project is subject to permit requirements, the applicant should
contact the District's Small Business Assistance Office at 557-6457, or our Permit
Services Section at 557-6400. To avoid unnecessary delays in the project, this should
be done as soon as the applicant has determined the scope of the project.
Thank you for the opportunity to comment. If you have any questions, please feel free
to contact me at (209) 557-6400.
Sincerely,
(
C32cRoe7cer
 / (rl C
TrBettencourt
Environmental Planner APCD REF#990067
Northern Region
