Analysis <br /> Background <br /> In 1983, U-83-24 was approved by the Board of Zoning Adjustment for a fruit stand for items not grown on <br /> the premises. <br /> On January 19, 2000, the Community Development Department approved SA-00-82 to convert a produce <br /> stand to a small agricultural store. The Conditions of Approval were not completed, and the approval expired <br /> on July 31, 2002. <br /> There is currently an enforcement case pending on the site for selling products other than produce. The <br /> applicant submitted PA-03-50 to bring the business into compliance with Development Title requirements and <br /> resolve the pending enforcement case. <br /> Parkinq <br /> The Department of Transportation (Caltrans) has submitted Conditions requiring a right-of-way dedication of <br /> 50 feet from the centerline of State Route 120 and paving of 38 feet from the centerline. This requirement will <br /> move the right-of-way of State Route 120 approximately nine feet from the existing building. As a result, the <br /> existing parking area will need to be moved to a different location on the property. This is not expected to <br /> create any significant problems because the property is large enough to accommodate a change in the <br /> location of the parking area.
