Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Use Permit No. PA-03-50 based on the Findings and Conditions of Approval contained
in the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the Genera' Plan, any
applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
This Finding can be made because the proposed use is consistent with the AIG (General
Agriculture) designation of the General Plan. Additionally, the Produce Sales use type may
be conditionally permitted in the AG-40 zone with an approved Use Permit application. The
proposed large agricultural store presents no significant General Plan policy issues, and
there are no Master, Specific,or Special Purpose Plans affecting the site.
tion, water
e, and
cessary
2 Aequae
roadway improvements,
provided, and the proposed aimproveme improvements propeayerelatedother
toex st ng and
proposed roadways.
This finding can be made because the site has public road frontage on State Route 120, and
all other services
to applicable Ordinance ing a well, septic tank, and Requements.orm water e are already in place
and will be expanded according
3. The site is physically suitable for the type of development and for the intensity of development I f
This finding can be made because the site is large enough at 44 acres to accommodate the
proposed use, even with the required dedication for roadway, and can conform to all
applicable Development Title regulations and requirements.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare or be
injurious to the property or improvements of adjacent properties.
This finding can be made because the Initial Study prepared for the agricultural store
expansion found that the project would not result in any significant, adverse environmental
impacts. Additionally, the agricultural store is already functioning as proposed on the site,
and no significant issues have resulted.
5. The use is compatible with adjoining land uses.
This finding can be made because with the proposed Conditions of Approval for the project,
the project will not be incompatible with surrounding land uses. Additionally, the site is 44
acres, which is large enough to accommodate the proposed uses on the site.
PA-03-50\G;{as
San Joaquin County Page 4
Community Development
