SA-95-47 OF TERRY REMITZ FOR <br /> FARM MACHINERY SALES AND HAY SALES LOCATED AT 21200 S. <br /> PARADISE ROAD, TRACY (APN: 213-170-03) (FIFTH SUPERVISORIAL <br /> DISTRICT) <br /> IT IS RECOMMENDED: <br /> That the Planning Commission in, accordance with Chapter 9-230 of the San Joaquin County <br /> Development Title, conduct a public hearing to determine if Site Approval Application No. SA- <br /> 95-47 of Terry Remitz should be revoked or modified if the Commission finds that one or more <br /> of the conditions upon which the development approval was granted was violated. <br /> BACKGROUND: <br /> On February 20, 1996, the Community Development Department denied Site Approval <br /> Application No. SA-95-47 due to the inability to make Findings 1 and 2. On March 1, 1996, <br /> Terry Remitz appealed staff's action to the Planning Commission. The Planning Commission <br /> heard this item at its regularly scheduled hearing of May 2, 1996. Don Moyer, representing <br /> Terry Remitz, spoke in favor of the item. No one spoke in opposition. The Planning <br /> Commission voted 7-0 to deny the appeal of staffs denial of Site Approval Application No. SA- <br /> 95-47, also due to the inability to make Findings 1 and 2 as contained in the Staff Report. On <br /> May 10. 1996, Don Moyer, representing Terry Remitz, appealed the Planning Commission's <br /> action to the Board of Supervisors. Staff and the Planning Commission determined that Finding <br /> 1 could not be made because the project was not located on a roadway designated on the <br /> General Plan as minor arterial or higher classification, as required by Section 9-605.5(h)(2) of <br /> the Development Title. General Plan Policy No. 2 of Transportation Coordination states that <br /> "transportation needs and access shall be considered when locating land uses." Finding 2 was <br /> not made because the project access is to Paradise Road, which is a two-lane road with a <br />
