Section 9-605.5(h)(2) of the Development Title <br /> requires sales of farm machinery to be located on a minor arterial, which is a four-lane highway <br /> with a minimum pavement width of 60 feet. It was determined that Paradise Road is not an <br /> adequate roadway for a farm equipment sales project. <br /> On June 25, 1996, the Board of Supervisors heard the appeal and voted 3-2 to uphold the <br /> appeal and approve Site Approval Application No. SA-95-47 subject to Conditions of Approval. <br /> The Board of Supervisors added a condition that Paradise Road be widened to a collector road <br /> standard with 40 feet of pavement across the project frontage. <br /> REASON FOR RECOMMENDATION: <br /> Commissioner Stan Morri made an inquiry to the Community Development Department staff <br /> because he had been receiving complaints that Site Approval Application No. SA-95-47 was not <br /> operating in accordance with the Conditions of Approval. Tom Sweeso, Senior Enforcement <br /> Officer, conducted a field review of the Remitz site on Monday, November 30, 1998. A memo <br /> was prepared to Commissioner Morn on December 3, 1998. On Tuesday, February 23, 1999, 1 <br /> met with Terry Remitz to review the status of the Conditions of Approval and conduct a follow- <br /> up field review of the site. The results are as follows: <br /> • Condition 1.b. states that the approved use is for farm machinery sales and hay sales and <br /> that Phase IV shall be completed prior to April 14, 1999. The application proposed that the <br /> use be developed in four phases, as follows: <br /> Phase I: Office; <br /> Phase II: Two open covered parking spaces; <br /> Phase III: Hay barn; and <br /> Phase IV: Shop and parking. <br /> Building permits have been obtained and finaled for the commercial coach, three cargo <br /> containers, and the hay and farm machinery storage structure. There is one additional <br /> cargo container that does not have a building permit. <br /> The Use Classification System defines Equipment Sales and Repair as the sale, rental, <br /> servicing, and repair of farm machinery, heavy equipment, aircraft, and a variety of leisure- <br /> oriented equipment. This classification is further broken down into Farm Machinery Sales <br /> and Farm Machinery Repair. F=arm Machinery Sales is for the sale, rental, and minor <br /> incidental repair of farm machinery. Typical uses would include tractor sales yards. Farm <br /> Machine Repair is for the repair of farm implements and equipment. Typical uses include <br /> welding shops and tractor repair shops.
