Civil Code Section 714, the Uniform Building Code of the County, applicable zoning <br /> regulations, and associated County ordinances. <br /> 3.1.15. Nonliability and Indemnification. Except as specifically provided <br /> herein, or as provided by law, no right, power, or responsibility conferred on the AC by <br /> this Declaration shall be construed as a duty, obligation or disability charged upon the <br /> AC or any member of such Committee. No such Person shall be liable to any party or the <br /> Committee for injuries or damage resulting from such Person's acts or omissions within <br /> what such Person reasonably believed to be the scope of his Committee duties, except to <br /> the extent that such injuries or damage result from such Person's willful or malicious <br /> misconduct. No Person who suffers bodily injury(including without limitation emotional <br /> distress or wrongful death) as a result of the tortious act or omission of an AC Committee <br /> member shall recover damages from such Committee member if all of the following <br /> conditions are satisfied: (a) the act or omission was performed within the scope of the <br /> AC Committee member's duties: (b) the act or omission was performed in good faith; and <br /> (c)the act or omission was not willful, wanton or grossly negligent. <br /> ARTICLE 4. <br /> GENERAL NEW CONSTRUCTION AND ALTERATIONS PROVISIONS <br /> 4.1. General Construction Provisions <br /> 4.1.1. Compliance With Laws. All Residence Units and other <br /> Improvements which will be constructed on the Covered Property shall comply with all <br /> public laws, ordinances and regulations applicable thereto and shall be constructed and <br /> completed at the sole cost and expense of Declarant. Declarant shall (and shall cause its <br /> representatives) at all times, while on the Covered Property and during all construction <br /> and other activities on the Covered Property, comply with all applicable laws, statutes, <br /> codes, ordinances, rules and regulations (collectively "Laws") applicable to the Covered <br /> Property and the activities undertaken thereon. <br /> 4.1.2. Government Approvals. Declarant shall obtain, at its sole expense, <br /> all governmental approvals and permits which may from time to time be required with <br /> respect to the performance contemplated by Declarant under this Declaration. In <br /> obtaining such approvals and permits, Declarant shall prepare as necessary and without <br /> limitation environmental impact reports, engineering studies and the like. <br /> 4.1.3. Signs. No sign, poster, display, billboard or other advertising <br /> device of any kind shall be displayed to the public view on any portion of the Covered <br /> Property, or on any public street abutting the Covered Property, without the prior written <br /> consent of the AC, except (a) one (1) sign for each Lot, not larger than eighteen (18) <br /> inches by thirty (30) inches, advertising the Lot for sale or rent or (b) traffic and other <br /> signs installed by Declarant as part of the original construction of the Covered Property. <br /> In addition to the foregoing, Declarant shall be entitled to place on the Covered Property <br /> such advertising signs as it deems necessary or proper for the sale of a Lot with <br /> Residence Units and which are in compliance with Declarant's marketing program for the <br /> 7 <br />
