Covered Property; provided, however, that all such signs shall be in good taste and in <br /> accordance with the usual practices of advertising in the house-building business in and <br /> around Stockton and San Joaquin County, California. All such signs shall comply with <br /> the statues, ordinances and regulations of any governmental entity or agency having <br /> jurisdiction thereover. <br /> 4.1.4. Obligation to Install Front Yard Landscaping and Side and Rear <br /> Yard Fencing. Declarant shall construct and install side and rear yard fencing on all <br /> interior Lots and block end areas of all corner Lots, in the area from the fence to the back <br /> of the curb, and front yard landscaping. The Owner of each Lot shall maintain all <br /> landscaping on his Lot and shall especially maintain the front yard landscaping, and, in <br /> the case of corner Lots, the landscaping between the fence and the street. <br /> ARTICLE 5. <br /> ENFORCEMENT OF DECLARATION <br /> 5.1. Enforcement; Assignment By Declarant <br /> 5.1.1. Enforcement. Declarant and each Owner shall have the right to <br /> enforce by proceedings at law or in equity, all restrictions, conditions, covenants and <br /> reservations, now or hereafter imposed by the provisions of this Declaration or any <br /> Amendment hereto, including the-right to prevent the violation of any such restrictions, <br /> conditions, covenants, or reservations and the right to recover damages for such violation. <br /> Failure by Declarant or any Owner to enforce any covenant, condition, or restriction <br /> herein contained in any certain instance or on any particular occasion shall not be deemed <br /> a waiver of such right on any future breach of the same or any other covenant, condition <br /> or restriction by the Declarant or Owner which committed such breach. All rights, <br /> options and remedies of Declarant and each Owner under this Declaration are <br /> cumulative, and no one of them shall be exclusive of any other, and Declarant and each <br /> Owner shall have the right to pursue any one or all of such rights, options and remedies <br /> or any other remedy or relief which may be provided by law whether or not stated-in-this <br /> Declaration. Anything hereinabove to the contrary notwithstanding, Owner (except for <br /> Declarant) shall not have any obligation or duty to anyone else to enforce any part or all <br /> of the provisions of this Declaration. The result of every act or omission whereby any of <br /> the provisions contained in this Declaration are violated in whole or in part is hereby <br /> declared to be and constitutes a nuisance, and every remedy allowed by law or equity <br /> against a nuisance either public or private shall be applicable against every such result <br /> and may be exercised by the Declarant. <br /> 5.1.2. Enforcement Rights. Any Improvement placed or made in <br /> violation of this Declaration shall be deemed to be nonconforming. Upon written request <br /> from the Declarant, Owners shall, at their own cost and expense, remove such <br /> Improvement and restore the land to substantially the same condition as existed prior to <br /> the nonconforming work. Should an Owner fail to remove and restore as required, the <br /> Declarant, shall have the right to enter the Lot, remove the violation and restore the Lot to <br /> substantially the same condition as previously existed.
