v <br /> CONDITIONS OF APPROVAL <br /> UP-00-8 <br /> Pollard <br /> Use Permit Application No. UP-00-8 was approved by the San Joaquin County Planning Commission <br /> on June 15, 2000. The effective date of approval is June 25, 2000. This approval will expire on <br /> December 25,2001,which is 18 months from the effective date of approval,unless(1)all Conditions <br /> of Approval have been complied with, (2) all necessary building permits have been secured and <br /> remain in force,and (3)all necessary permits from other agencies have been secured and remain in <br /> force. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Jim Van Buren, 468-2374) <br /> a. BUILDING PERMITS: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT." The <br /> Site Plan required, as a part of the building permit must be prepared by a registered civil engineer <br /> or licensed architect. This Plan must show drainage, driveway access details (including gates), <br /> on-site parking, landscaping, signs, existing and proposed utility services, and grading (refer to <br /> the "SITE PLAN CHECK LIST' for details). A fee is required for the Site Plan review. <br /> (Development Title Section 9-884) <br /> b. APPROVED USE: This approval is to add restaurant services and theatrical performances in an <br /> existing live entertainment / dance bar, establish a ghost town outdoor historical walking <br /> amusement area, add an outdoor group functions area, add retail sales in various existing <br /> buildings, add guided tours, and allow semi-annual special events. <br /> (1) Phase One Approvals: Within 18 months from the Use Permit approval date, all Phase One <br /> conditions shall be met. <br /> A. Guided Tours: Guided tours for school children or adult tourists of the facilities shall <br /> average one or less a week. Tours shall take place between 9:00 a.m. to 1:00 p.m. Bus <br /> parking shall be in the automobile parking areas. <br /> B. Semi-Annual Special Events: The events shall consist of a two-or three-day special event <br /> with a maximum 300-person capacity on the site at any one time. Hours of operation <br /> shall be 10:00 a.m. to sunset. The semi-annual special events shall require an <br /> Improvement Site Plan approval from all applicable departments for each of the semi- <br /> annual events as each one is scheduled. The Improvement Plan will address any health, <br /> safety, or welfare issues that that arise from these events. <br /> C. Restaurant Services and Theatrical Performances: The dinner theater(#2 on Site Map) <br /> hours of operation shall be 12:00 p.m. to 11:00 p.m., Monday to Thursday, and 6:00 p.m. <br /> to 11:00 p.m. on Friday, Saturday, and Sunday. During the hours the dinner theater <br /> business is operating, the dance bar business shall not operate. To the rear of the dinner <br /> theater(#2a on Site Map), the theater storage area use is approved.
