Analysis <br /> Background <br /> On July 28, 1998 the Board of Supervisors adopted Resolution R-98-340 and Ordinance No. 3984, <br /> amending the General Plan designation of a 16.26 acre parcel from A/L (Limited Agriculture) to I/T (Truck <br /> Terminal) and reclassifying the same 16.26 acre parcel from AL-5 (Limited Agriculture 5 acre minimum lot <br /> size)to I-T (Truck Terminal). With the exception of an off premise sign constructed in 2003 (PA-0300302), <br /> the project site has remained undeveloped. <br /> On July 26, 2007, the applicant submitted a General Plan Map Amendment to amend the General Plan <br /> designation of the aforementioned 16.26 acre site from I/T(Truck Terminal)to C/FS (Freeway Service <br /> Commercial). The Zone Reclassification application was not submitted at the time to allow the Community <br /> Development Department to review the project and determine if the project site was an expansion of the <br /> urban community of Stockton. <br /> Upon review it was determined that the project site is located outside of the urban community of Stockton <br /> and therefore is not an expansion of the urban community of Stockton. <br /> On December 6, 2007, the applicant submitted a Zone Reclassification application to reclassify the same <br /> 16.26-acre site from I-T to C-FS. <br /> City of Stockton <br /> The Community Development Department received one letter of opposition from the City of Stockton <br /> Community Development Department, Planning Division. The City of Stockton recommends the project be <br /> denied because the project is inconsistent with applicable goals and policies of the recently adopted 2035 <br /> City of Stockton General Plan. Specifically, the proposal to develop an independent, freeway-oriented <br /> commercial use project should be abandoned in favor of a comprehensive residential project with integrated <br /> commercial uses. <br /> In response, the project site is located outside of the urban community of Stockton as well as the sphere of <br /> influence boundary for the City of Stockton. The proposed General Plan Map Amendment meets the <br /> Development and Locational criteria for the C/FS (Freeway Service Commercial) designation as identified in <br /> Vol 1, pp IV-25,26, of the San Joaquin County 2010 General Plan. <br /> Basis for General Plan Amendment <br /> Development Title Sect 9-803.4 states that prior to approving the General Plan Amendment, the Board of <br /> Supervisors will have to determine that the internal consistency of the General Plan is maintained in <br /> adoption of the proposed General Plan Map Amendment. The proposed change must be consistent with all <br /> of the various General Plan goals, policies, objectives, and implementation measures. <br /> Function <br /> The function of the Commercial Freeway Service is to provide for commercial uses oriented almost <br /> exclusively to serving the needs of the freeway or state highway traveler. <br /> San Joaquin County PA-0700359 & PA-0700571/1-oduca <br /> Community Development Page 3 <br />
