`.s
Philip Yee
4340 S. Hwy99 Frontage Rd,
Stockton, CA 95215
Oct. 10, 2006
Dear San Joaquin county Planning Commission,
I, Philip Yee and Shirly Zhai, are the owner of the property of 4340 S. Hwy-99 E. frontage
Rd.
We apply for a Revisions of Approved Actions application to Use Permit No.295 & 315
to remove the 3 conditions on a regular eating establishment license: THE
RESTAURANT SHALL NOT SERVE ALCOHOL AFTER I1:OOPM, DANCING
SHALL NOT BE PERMITTED INDEPENDENTLY FROM THE OPERATION OF
THE RESTAURANT AND LIVE ENTERAINMENT SHALL BE PROHIBITED
EXCEPT AS PERMITTED UNDER TABLE 9-505.4. (According to the California
Liquor License Law, alcohol can be served until 2:OOam.) But we are not Mlyin f¢ or a
dancing bar permit or license.
The reason for the conditions was the previous business Donald's Place breach the liquor
license law and misused the permit in order to run the main business as a dancing club.
They only served few items of finger food and mainly serve alcohol and provide live
entertainment to patrons. The poor management and the wrong clientele caused lots of
violence occurred on the establishment for their last two years. They should liable for
their mistake, but not the new property and business owner.
Since we purchased the property and directly managed the business by us, we tum the
business into a fine dining restaurant with an ancillary bar. We stay at the business full
time and supervising all our customers and staff. There was not any complaint of
violence on site to the sheriff Department since the ownership of the property has been
changed.
Today, we would strongly request everyone here listen to our story, walk in to the
restaurant to take a look. If we have the same attitude to run a business like Donald's
Place, we would not be here today and waste money for hiring an attorney to apply for
remove the conditions. We can just run the business ignoring any regulations and rules.
But we choose to run the business in a right way to completing any of the right
procedures to meet the entire requirement. Do you still encourage restrictions shall put
on such a regular eating place liquor license? For a health small business, we need the
support from the local government but not the restrictions.
The facts for applying to remove the conditions :
1. The bar never operates independent of the restaurant.
2. We have already catering few parties and held for 4 large special events that have
Permits and there were not any violence or criminal had been occurred.
