Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit Application No. PA-02-364 with the Findings and Conditions of Approval <br /> contained in the Staff Report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the use types Religious Assembly-Community and <br /> Educational Services-General may be conditionally permitted in the AU-20 (Agriculture- <br /> Urban Reserve-20 acre minimum)zone with an approved Use Permit application. There <br /> are no Master Plans, Specific Plan, or Special.Purpose Plans in the project vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the Department of Public Works is requiring that <br /> applicants to obtain an encroachment permit and improve the driveway approaches along <br /> State Route 99 East Frontage Road in accordance with the requirements of San Joaquin <br /> County Standards CW-C11 or CW-C12 prior to issuance of the occupancy permit. Traffic <br /> Impact Mitigation Fees will be required prior to issuance of the building permit. The <br /> Environmental Health Department(EHD) is requiring as a condition of approval that a soil <br /> suitability/nitrate loading study be prepared to determine a suitable area for septic tank <br /> usage. All storm water drainage will be retained on-site in a storm retention pond. <br /> 3 The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 5.6-acre parcel is of adequate size to accommodate <br /> the size of the classrooms, sanctuary building, parking lot and storm drainage retention <br /> pond. All new buildings shall comply with the setback requirements of the Development <br /> Title for buildings and structures in the AU-20 zone. The parking lot and circulation <br /> patterns comply with the requirements of the Development Title for two-way access. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because an Initial Study prepared for this project found no k <br /> potentially significant environmental impacts that could not be mitigated to a less than <br /> significant level. <br /> ' San Joaquin County PA-02-364\Stockton Baptist Church & School <br /> Community Development Page 6 <br />
